I signed up for a 6 week weight loss challenge on 5/9/2022 which would end on 6/21/2022. The purpose of the agreement is that I can either sign up to lose 25lbs in 6 weeks or 6% body fat. My target was set by *******************, the manager of the location as the 25lbs challenge. The contract states a few requirements along the way, such as ******** check Ins for each class, which is 3 times per week and things like that. As far as the final weigh in, the contract states: "A successful completion of the 6 week challenge entails a loss of 25lbs as measured on in-housescale at the time of their final weigh out at the end of their challenge approximately 42 days after the first official "weigh-day day" or (different check box) 6% Body fat at the final weigh out at the endo of their challenge as measured on in-house Omron monitor, in each instance captured by a facilty employee on an in-house system."Today, via text message, the owner/manager of the location sent me a text message to inform me that since I weighed on Friday (6/17) which she thought was my final work out, I would not be getting my $499 deposit back. I explained to her, that per the contract, I have a time limit of "approx 42 days" and it says nothing about a requirement of me weighing in on the final work out day. Also, I explained to her via text, with her confirming accuracy of, that I had received verbal permission to weigh in on Friday from her, upon leaving my final work out on Thursday. Lastly, the contract clearly states that the weigh in must be performed by an employee of the location. On Friday, I went there to weigh in, I was 1/2 lb off target, so I left and came back several hours later to weigh in with a staff member. There is nothing in the contract stating I cannot do that, nor did the original staff member make an attempt to weigh me in. I feel I am owed the deposit of $499 back and I am backed with insurmountable proof/documentation.Business response

Headquarters has no control over customer billing, does not render services directly to clientele nor do we accept payments for services rendered. Challenge rules are pre-determined and it is up to the individual locations and maintain and uphold the standards and challenge rules.
In order for this issue to be resolved, the member must address it with the individual location.
We have informed the location of the members issue and have advised them to reach out directly.
