We contract it on a pool. After we contracted the funding source we were going to go through was no longer doing home equitys. So we had to figure out a different route. We asked him to hold off and he agreed. We got our funding, and we asked him to start up again. He agreed. Also indicating that he was going to charge us more money because of cost to him. We sent a few texts going back and forth about it he text us stating that he was going to refund us and walk away friends. Because we didnt answer right away, he is saying he will not give us our $1000 deposit. I can add the entire text messaging. I will print it out and attach later if needed.Business response

There was a delay of over **************************************************************** to go ahead with the pool due to issues with their financing. The contract states that prices in the contract are only valid for sixty days due to rapidly changing costs. I gave them the option of null and voiding the contract due to an increase in the cost of materials. They argued with me that I was bound to the price of the contract. When I pointed out the provision in the contract about the 60 days, Mr. ******** asked what the cost increase would be, which I had already told him. We were in contact on the phone multiple times, so some of the texts between us are not in context. I returned $1250 for some monies that were over the contract price, but work was done on my end, and once work has been done, the deposit is not refundable. ***** also agreed to give us a FULL refund after the discussion of the increased prices. We have never been in a contract where prices increased so yes we did question it. After ***** pointed out where this was stated in his contract, we wanted to clarify what the exact amount would be. ***** then offered to give us a full refund and part as friends. Our reply was not fast enough for ***** and now he refuses to give our deposit back. He did NOT start anything as it was ALL on hold. We have the full conversation in a text from ***** stating all of this. ***** claims he started, but it was on hold and he did NOTHING.Business response

Unfortunately, Ms. ******** is incorrect in her description of what transpired, using texts that are out of context and out of sequence in our conversations which occurred by phone and texts. I did tell them that I would return their money if they did not agree to the price increase, but rather than accepting my offer, they attempted to hold me to the original contract price. When I showed them where the contract stated that price increases could occur after delays, they started asking about the amount of the increase and did not mention cancellation again. I did not hear from them for weeks and then they started asking for a refund of their deposit. Contrary to what Ms. ******** states, I did work on the pool and incurred the costs of submitting the pool to an engineering firm for engineering plans. When costs are incurred, time is spent and the customer does not notify me of cancellation according to the contract, I am not able to refund the deposit. I did return the $1,250 that they had paid me in addition to the contract. Respectfully submittedDavid *******, Owner of AAABAR Swimming Pools.
