November 4, 2021 I gave ******************* a check for *******. Deposit for landscaping the backyard.Between then and Jan 20, 2022 whenever I messaged **** for information on the job I always received an answer of "next week." Always next week he'd know something about timing, materials.Jan 17 and 19 2022, left two unreturned phone calls on the answer machine (always the answering machine, no one answers the phone) that I would like my deposit returned.Jan 20, 2022 ********************* emailed me to reconsidered due to the family hardship and business troubles. She wrote that "next week" they could start the job. But start what? No materials had been agreed upon or even discussed. I had said in November I wanted a certain paver but had never been informed if I could have that.I emailed back that I was very sorry for their troubles (I am!) but it was too much money to be sitting around doing nothing. Refund please.Jan 25, 2022 ******************* messaged me he could not get the pavers I wanted but would like to show me something else. For the fourth time I asked for my ******* dollars returned.I've heard nothing from them since. I realize that all jobs now are subject to supply shortages, man power shortages, and the awfulness of having people be on death's door with covid. Never did I expect my backyard to be immediately completed. But a constant answer of "next week", no phone answering, no materials discussed until after I want my money returned, I have lost confidence the business can do what we contracted at this time.I want ******* dollar deposit returned.Business response

Hello ******,
I wanted to get back to you regarding this. Your contract was signed October 27th and the deposit made On November 5th. The project projected start date is **** weeks from deposit and materials selection and that is weather permitting. We also had 3 major holidays during that time as well as several weather delays. Materials selections had also not been finalized and due to materials volatility things have to be selected and sourced in order to provide an exact start date. I was also in the hospital from August until November with Covid and that also caused issues. I also know you had told **** you had some issues with your pet and I am sorry for that. I instructed **** before this complaint was filed to go ahead and cancel your contract and then we received this complaint. We will be returning your deposit if that is what you would like without charging a cancelation fee as outlined in your contract. We are truly sorry for the circumstances and upon your acceptance of these terms and cancelation of this complaint we will mail out your refund of the deposit you put down for your project. We wish you all the best and we wish you well with your project. Have a great New Year.
