      Failure to show up to complete the remainder of the project (block wall installation, gate installation. Minor stucco, paint fence) on Monday May 22, 2023 phase 2 (install gates and paint)They were supposed to install the 2 gates in backyard and complete the painting portion of the block wall they installed. We arranged and agreed on Tuesday May 9, 2023 @ 8:28 AM after stucco cured to paint and install of the 2 gates on Monday May 22, 2023 **** told me a second time they would show up on Tuesday May 23, 2023 to complete the paint and block walls and did not show Later that day on Tuesday May 23, 2023 **** said they will not come out unless paid in advance. That is not what our contract says. He is trying to change the terms of the contract and purposefully delaying the project I suggested I could get a quote to paint since he was once again complaining about paint matching and adding wording to the contract in an email of which I did not agree with. Since he was attempting to change the terms of the contract in an email of which I did not agree with and was untrue my suggestion was to let me hire someone else to do the paint portion since they didnt even know how to paint match. The last day of the job his worker asked me repeatedly how he can match the paint? I asked him who is painting they must know how to do a paint match? I suggested taking an existing piece to match the paint cause he kept stressing about it even though HE WAS NOT THE ONE DOING THE PAINTING he told me. Changing the terms of the contract that was signed on 4/14/2023 today by sending me yet another email on Tuesday May 23 saying he will not come to hang the gates or do the paint until I pay in full in advance before they start the work. I reviewed my contract again today and it clearly says 50% deposit, 50% upon completion. IT DOES NOT SAY PRIOR TO COMPLETION. He told me he would show up a 3rd time on Wednesday May ************************************************** advance.

      To Whom it may concern,
      My name is *** Lindstrom, and I am the owner of Lindstrom Ltd.
      LLC. DBA Pinnacle Fencing Solutions. *********** **** signed ***
      ******* written contract on 4/26/23 and it will be attached to this
      email. The written contract has the scope of the project but to
      summarize it was **** linear feet of 6.5h 4x8x16 fence block wall. 13
      of 6.5h 4x8x16 wall for the trash enclosure with stucco and paint.
      Including saw cutting a concrete pad for block wall footing. It Included 2
      custom 4w x 6.5h gates with composite boards and included welding
      two new garden latches on two existing gates. The scope of the signed
      contract should have taken 5 working days at most to complete.
      Because of working on top of the other trades, going through the
      garage with all the material, and finishing other contractors jobs It took
      us 5 working days to complete only the block and stucco.
      My crew showed up to start her project one week after signing the
      contract, on 5/01/23 at approximately 7am. The crew consisted of my
      ******* *********************** who has been with me for 13 years and two
      laborers that have each been with me for over 2 years. When they got
      to the project, they discovered that ******************* had scheduled the
      pool plumbers and electricians for the same day. We never agreed to
      work on top of other trades. The only access into the property was
      through a single walk gate that was now an open trench with literally 3
      plumbing side by side for the pool that went across the entire gate
      opening. She told us that we were to go through her garage and then
      out a side door to gain access. This route had a step up in the garage
      and then a side door threshold to deal with and then once we got it
      through the door, we had to lift **************** over the open trench
      in order to really gain access to the area that we were working that is
      adjacent to the open trench and very difficult to work around. We
      continued on with the project.

      When digging our trench for the block wall footing, we broke some
      of the pool plumbing but luckily the plumbers were there to fix it so
      that we could continue with the project. We also hit irrigation lines but
      we fixed those on our own at no charge. ******************* is asking for $420
      dollars in damages for the pool plumbing company. It is the amount of
      the repair bill from the plumbing company on site. I would like to bring
      your attention to the fine print on the contract, item #6 Unless
      otherwise stated it has been assumed that all excavations are in normal
      soil or **** free from chalk, caliche, gravel, rocks, roots and footings.
      Removal of Obstructions will be charged extra. It is standard practice
      to call Blue Stake to mark the utilities, but they only mark the service
      feeds to the house and nothing else. The only way to know what is
      underground aside from the Blue Stake is to have a private locate
      company out to the property. This is an option but is usually discussed
      and put in writing. It was not. We continue on with the project.
      When the crew gets to the saw cutting of the concrete pad in order
      to get the block wall footing into the soil and it turns out the ****************** pad is floating approximately 10 to 12 inches off the soil
      below (see pictures). After ******************* asked me what I was going to
      do about it I explained to ******************* that 1. It is not our fault that the
      concrete is above the soil and 2. That I am not licensed to fix it and will
      have no part in it. This caused us to have to add block to the wall to
      make it taller and also caused us to have to work under the pad to pour
      our footing.
      When the plumbers were finished, they left the trench wide open.
      ******************* instructs my crew to try and stuff soil spoils from the
      trench under the floating concrete and fill the trench and level the soil
      (out of scope). They comply because I have instructed them to try to
      make her happy so we can complete the job and move on to the next
      one. Also, on this day ******************* will not let the crew wheel *********************** on the existing pavers next to the driveway because she
      says it looks too heavy and insists it would damage the pavers. We are
      told to continue to use the garage with the step up and doorway. My
      *************************** also notifies me that ******************* instructed them to
      make the garbage can area an additional 7 linear feet longer ($819)
      without first prompting a change of scope to be approved. We continue
      on with the project.
      We ask ******************* to provide the paint color of her house and she
      instructs us to figure it out because she does not have the color.
      Thats no problem and we usually will take a cap off of something on
      the house or a cover to color match and then replace it when we come
      back to paint, but ******************* would not allow that and told ****** to
      chip it from the existing wall and then repair the stucco. So, we did. We
      got a message later that stated that she wanted to approve the color
      before we put it on. At this point I have already had it paint matched to
      the chip and ordered the paint. 5 gallons of primer and 5 gallons of
      color finish ($390). But also, at this time ******************* has scheduled the
      pool decking people so she doesnt want us to paint until they are
      finished. I let her know that it is ok with us and that we will be out on
      the day she requested. At this point we have had a lot of conversations
      through text, email, and phone, and I am not sure what all *******************
      is choosing to hear so I put together an email stating all of the
      conditions of the project to date that are out of scope and request that
      she only corresponds with me through email. I wanted to stay
      organized because I could see her behavior getting erratic and wanted
      to protect myself. ******************* then got upset that I sent the email and
      of course would not respond to an email and would only send texts
      both to myself and to the salesman Rich. At one point I sent her a text,
      trying to get the project finished (see attached) and she called me
      names, so we havent talked since then.

      In order to resolve this issue, I am willing to complete the project if
      these items are addressed. The remaining tasks are:
      ? Install 2, 4 wide x 6-1/2 high pedestrian gates with a 1 steel
      kickplate at the bottom and dark composite slats. The gates are
      built and ready for installation.
      ? Install 2 garden style gravity latches to the customers existing
      gates
      ? Paint the newly constructed walls with the paint that has already
      been purchased and successfully color matched to *******************
      existing paint.
      ? The remaining balance of $4,418. (balance of the original contract
      + the amount of additional wall around the trash enclosure wall
      that she authorized) + $819 = $5237 needs to be paid
      immediately, and the $420 repair bill needs to be paid by her, to
      the company she contracted with for plumbing, that did the
      repair.
      I ask that whomever is reading this please consider that I have been
      in business for 18 years with a clean license and happy customers. She
      did sign a contract that she didnt read the fine print and from day 1
      she never wanted to accept responsibility for anything that was her
      property. It was somehow the contractors issue if something was
      discovered out of scope of the contract. ******************* has repeatedly
      asked and instructed my crew to perform additional services that are
      not in the contract and has made what would be a quick and easy job
      into a very difficult job that was poorly scheduled and managed by Mrs.
      *******. She acted as the general on her project and was responsible
      for the scheduling. I have been in contact with the pool plumbing
      company and they had the same experience with ******************. They
      have yet to be paid the balance. This seems to be a pattern for Mrs
      *******. Although she has basically called me a liar many times and

      accuses me of changing the terms of the contract, I have a long
      history of working with people to find solutions and finish jobs. I thank
      you for your time and consideration.
