      Moving Claim ***-983-21/Claim #****** I used Dricks to move and store my furniture and possessions while I moved. They returned several items damages all of which were fixed by their insurance except two rugs. ***** at Dricks sighted extreme temperatures for the rugs being damaged. She is 1) misinterpretting the language in the contract ans 2) in phoenix during October - March the time which the rugs were stored there were no extreme temperatures. The rugs obviously had something spilled near them or were exposed to a liquid which damaged them.I would like my rugs replaced, they are $625 each at pottery barn.Please resolve this.

      We are very sorry for the damage to your property.  Our insurance company handled the claim and as noted all damages were fixed.  The rugs claimed are 16 years old, the sticky backing is known to deteriorate over time.  Therefore, this type of damage would not be covered.   Section 4 of the warehouse agreement we had with you states: 

      LIABILITY OF COMPANY IS LIMITED. (a) It is agreed that the goods are moved and stored at Depositor's risk with respect to damage, loss, or delay caused by extremes of temperature,dampness of atmosphere, fire, acts of God or the public enemy, war,insurrections, strikes, labor troubles, riots, earthquake, nature of property or defect of inherent vice therein, deterioration by time,moths, vermin, rodents, leakage and heat. Company shall not be liable for damage or injury to pianos, computers, television, radios, CD players, cameras,clocks, refrigerators, or other instruments, electronic apparatus, or appliances in respect to the mechanical functions thereof, whether or not such are packed, unpacked, stored by employees of Company or others. Company shall not be chargeable with knowledge of the contents of containers or the condition therein; (b) Company shall not be liable for injury or damage to fragile articles (article susceptible to breakage or crushing) that are not packed by its employee; c) Company shall be liable only for its failure to use ordinary care and then only upon the basis of Depositor's declared valuation of the goods as determined by *********'s selection on the front side hereof. The burden of proving negligence or failure to use the care required by law shall be upon Depositor.

      I had Dircks pack all glass shelves and glass tops for my bedroom furniture. In previous moves with other companies, whatever was packed by the company was unpacked. The glass was wrapped in padded paper and packed in cardboard. The boxes were stuffed making it impossible to move. As an example, in one box a smaller package with 3 shelves and packing paper weighed **** #! I'm 71 and cannot lift and take apart these boxes. ****** the coordinator, wished me luck and ***********************, the salesman, said that he should have mentioned a charge for unpacking. I realize that they are trying to have fewer boxes but I believe common sense would dictate smaller, lighter boxes. The people that they have hired to move have a capability to lift and carry far more than the average person. I also told *********** that the packages were not labeled. The large box I was working on in the bedroom had nothing to do with the bedroom. They were shelves for the Living Room and Office. Thank you for looking into this.
