      I am reporting false advertising and abandonment of purchased remodel work/repairs under warranty from a remodel estimate and signed contract with RKO Construction LLC. My job began in September 2022 to be completed by December 2022 and still is not complete as of 10/1/23. License Owners: *********************, ********************* Contractor Phone: ********** Contractor Email: ************************************* Contractor License Number: ROC ****** At the time that my remodel estimate was drafted in fall 2022, the contractor and owner of RKO construction, *********************, was employed by ********* LLC. The contractor was advertising his business, RKO Construction, as a "division of KC Krew" online. Before the contract was signed, the contractor was fired from ********* and allowed me to unknowingly sign a contract without clarifying that they were no longer connected to KC Krew. To date, RKO construction is still advertised online as "a division of KC Krew" on Houzz.com and Facebook.com, which is false and misleading. I would not have signed the contract with RKO Construction if I'd known this contractor had no affiliation with *********. My business was poached by **** from the construction company I intended to work with. I spoke to the owner of *********, ***********************, by email and phone. She verified that **** was not affiliated with ********* on the date I signed my contract and confirmed that he was fired for carelessness. She confirmed that she never knew about my initial business inquiry to ******* in August 2022 despite the fact that **** was employed by her in Sales at the time that I contacted ********* via their business website (he was listed on the website). I showed her the advertisement of RKO as "a division of *********" on Houzz and ********* which she confirmed should be taken down.Finally, RKO never supplied a countersigned version of the contract I signed and submitted in September **************************************** writing.Thank you,*************************

      On 6/6/2023 I called RKO construction (*********************) and asked how busy he was, and could he give me a price on a complete renovation and a possible room addition on my home in north *******, I explained to him that I had a little less than 90 days to complete the renovation because I need to move in by September 1st. He stated that he could do the renovation on the home in 4-6 weeks but that the room addition would take longer because of permits. We agreed to a contract for a complete renovation inside and out for the home and to another for a room addition with the house being finished with in a 4-6 week time frame so that I could move in by September 1st. Over the next 13 days I paid **** a total of $36,355.95 two 25% payments for the renovation and one 50% payment for the room addition. Long story ******************** and his crew started demo on 6/8/2023 and never completed it, the house stood empty and torn apart for the next 3 and a half weeks with little to no work being done, I had several conversations with **** stating my concerns and he always agreed but said he would turn it around and not to worry, on 7/20/2023 I met with **** and we agreed that this was not working as planned and he agreed to meet on Sunday 7/23/2023 at 8am to walk the job and agree to a refund. We met, walked the job and signed an agreement for a $25,000 refund, I asked when I could expect the refund and he stated sometime before Wednesday 7/26/2023, Today is Friday 8/11/2023 I am still waiting for my refund of $25,000. Since I took the job over, I found out that the work that ***** crew did was so bad I had to pay to have it redone. In 14 days I started and completed drywall repair, tape and texter, rough in electrical and plumbing, all doors and one window replaced. Painters are starting today, ac replacement tomorrow and tile on Tuesday, I guess my point is you have to man the job and buy material in order to get the job done.

        We apologize for our delayed response. Times have become extremely tough and while there is no excuse for what happened with *r. *** job, we have definitely been struggling. It was never our intention to fall behind with *r. *** job. We always go into every job with the best of intentions and an estimated timeline. We hired the wrong subcontractors and we are paying dearly for it. Our company has fallen behind in this recession like a lot of others in our field, and we have always relied on cashflow to keep our business running. That cash flow has dried up and we have not been able to move forward on jobs or give *r. * his refund. We have plenty of opportunities that have presented themselves, unfortunately none of those opportunities have moved forward at this time. We fully agree that *r. * is *********** his refund and we have every intention of getting him paid back as quickly as possible. We will stay in contact with *r. * and keep him updated of the situation to get this matter resolved.

      ********************* wants to blame everyone else but himself for his business failing, he assured me that he had the time and the resources to complete my renovation in a 4-6 week time period. I paid him $36,335.95 over a 13 day time frame that ran from 6/8/2023 - 6/20/2023. He started demo on 6/8/2023 and never completed it, sometime around 7/10/2023 he maned the job with 4 men for 2 days and attempted to finish the demo and start the drywall, on 7/14/2023 I met with **** and addressed my concerns, I asked him if he was having money issues because I notice that no material had been bought or delivered to the house, I gave him another week to turn things around, On 7/20/2023 I fired **** and he agreed to a refund which he never paid. ********************* took $36,355.95 from me the first two weeks of the contract and spent that money (my money) financing his school project or other projects, he had my project for 6 weeks, never purchased any material, never completed the demo and the work that his crew did do was so bad that I had to pay another drywall contractor $3500 to fix it before I could continue with my renovation. I took the project over on 7/26/2023, on 8/2/2023 my first contractor started, on 8/31/2023 the inside of my home is complete and I will be moving in on September 12, 2 weeks later than planned and about $50,000 more than what it should have cost do to the actions of ******************* (RKO construction)
