I was a victim of domestic violence by the a young lady and now trying to recoup damages in arbitration using USA Mediate. As the Claimant, I was recently informed that USA Mediate – Arbitration & Mediation Centers also known as AMCA has conducted unethical practices within their process of arbitration. AMCA is attempting to take advantage of the Claimant and Respondent by manipulating the process for their own increased financial gain. On Jan 11, 2022, I mailed off the $300 Admin Fee to AMCA to Demand Binding Arbitration. My check was immediately cashed. I assumed that the process was beginning. AMCA was to begin the process by forwarding my Demand to the Respondent. The Respondent would then have five business days to respond to the Demand. However, two and a half weeks went by and I didn’t receive any type of response from AMCA. On Jan 27th, I contacted Mr. Fred D******* and he stated that his employee never issued the Demand. AMCA finally sent out my Demand for Arbitration on Jan 28th. The Respondent defaulted by not responding on Feb 7th. An entry of default was sent out by AMCA. The Respondent then missed the Feb 15th deadline and defaulted for a second time after 19 days and 10 business days.On Feb 17th, two days after the deadline, AMCA stated that the Respondent requested a deferral arrangement for the Admin Fee payment. I questioned why that email correspondence wasn’t forwarded to me as all of the other. No explanation. I called manager Fred by phone and recorded, he lied and said the Respondent sent an email with the request. I was later informed by a family member of the Respondent that someone at AMCA provided legal advice to prevent my entry of default. AMCA was supposed to remain neutral. I believe AMCA tried to manipulated the process to force the five hour $2000 fee rather than grant me the default judgment. I filed a Claimant's Application for Entry of Default. AMCA then withdrew from services keeping my fee and not administer the default.
