      I hired Mossman to build my pool back in 2020 and had to fire them in May of 2022 as they were unable to complete the job correctly. Here is a brief summary of what was done wrong:1) The shotcrete (shell) was installed to the wrong height and had to be redone. 2) The Negative edge wall had the be chipped out as they incorrectly leveled this wall for tile. 3) The height of the perimeter tile was not straight and had to be redone. 4) 2 returns in the trough were embedded into the wall and had to be cutout 5) The deck jets were installed incorrectly (no. drain and no power)6) the pool leaked upon startup so our tile deck had to be cut out to repair the leak 7) the spa still leaks and we are trying to determine cause 8) Contract required that steel be installed under the tile to cover the wet edge and they were not able to provide 9) Price of pool was approximately 25-30% higher than their contractual price...and it is still not done 10) delays in their performance delayed the completion of my home

      - We signed the contract for the pool build in early July 2021 for ~$52K. At the time deciding on the contract **** was very helpful and responsive which we greatly appreciated.- For 3+ months the pool remained without shotcrete reportedly related to COVID/concrete delays. We were informed that once shot crete was delivered then the remainder of the pool building process would be completed in a few weeks to one month. - On a Saturday (2 days prior to shotcrete), Mossman pools requested an additional $4,000 for the shot crete to be completed. While this was not in our contract that we would need to incur the extra charges for delays, we did so to avoid further delays for the pool build.- I have spoken to other pool companies and friends who have had recent pool development and from contract signing their pools have been completed after 3-4 months. I am not sure why in this current climate Mossman pools continues to have unreasonable delays, yet other pools are being completed in a timely manner. - Finally, the most crucial of issues. we are unable to convert our construction loan into a mortgage until the pool is complete. We are currently paying VERY HIGH interest only payments every day as we watch no one work on our pool with lack of communication regarding the reason for unnecessary delays. Furthermore, their limited crew is on other projects.

      In Response to the above.

       

      The client did sign a contract back in 2021.  While I am not sure where they got the feed back from friends that their pools are only taking 3-4 months to build, if it was prior to 2021, that makes sense.  Since then we have experienced mass industry shortages, shotcrete/concrete truck driver shortages, powder shortages, and equipment shortages.  This is not just Mossman Brothers Pools, this has been industry wide.  I have articles from ************* that anyone can look up to see this is true.  We have struggled with labor and material increases as well.  Plumbing has taken a 30% increase, labor increases, the raw materials increases.  We incurred most of these expenses.  We only went back on items that were most incremented, such as shotcrete and final interior finish.  The other items the Atias paid for were for items they upgraded such as tile and coping.  The process has been long, and if you ask ************* people, you will know that this is the norm.  We have suffered greatly as we too have had a rough time keeping payroll, lights on, rent paid, insurance, etc, while waiting for subcontractors to put us on schedule to do these projects because they were backed up weeks at a time.  We are used to 3-4 month turnover as well, as when it is not, the jobs are simply not profitable.  I cannot express enough how difficult it has been in this industry.  Meanwhile the pool is done and is beautiful. (Pool startup dated 5/13/22)   If you were to ask the Atias now, they should agree to this.  T.  I believe this time of construction will soon pass with all the good memories they will have with their new beautiful pool.

      My pool had a leak and was under warranty, I had this company come out and take a look at it and fix it.A guy named **** came out and fixed the leak, however he also took a look at the existing equipment and started "fixing" a few extra things, that were not installed by this company in the first place, without asking for my consent (and were not related in any way to the leak) and broke and took apart a valve alternator previously place by a different company and that was in perfect working order, told me it was defective and that he was going to come back the following week with a new one not even being aware of the fact that IT WAS NOT previously installed by the Company (Mossman Brothers) he works for. After he left my house I called the company that services my pool weekly (Aqua Dr.) and that had installed that valve alternator previously to let them know that a Mossman brother Company technician has just finished working on the pipe leak I had, but also took a look at the valve alternator, took it apart stating that it was not working correctly but would be back with a new one free of charge (not knowing that the company he works for aka Mossman Brothers, didn't originally installed it). I had Aqua Dr (the company i currently use for weekly pool maintenance) out here the day before Mossman Brothers Company came out to fix that pipe leak and everything was working perfectly fine. I did not have an issues with any of the equipment except that pipe leak.Aqua dr, my currently pool company service then called Mossman Brothers letting them know that that alternator valve was actually working properly and there was no need for their technician to take it apart in the first place and questioned them as why they would even do something like in trying to fix something that wasn't related to the pipe leak they were there to fix, was NOT even installed by them and I had no issues with.Mossman brothers now refuses to fix and replace the Valve they broke.
