Subject: Urgent Request for Assistance Regarding Potential Violation of State Licensing Requirements by Sierra Collections & Consulting LLC Expired License #CA-0933129 Dear Arizona Department of Insurance and Financial Institutions, BBB.org I am writing to bring to your attention a serious concern involving Sierra Collections & Consulting LLC, located at *** ***** *** ***** ***** ** ****** ****** ** ****** ***** ********* It has come to my attention that their license status may have expired, yet they continue to engage in collection activities that raise significant legal and ethical concerns. Despite having fully paid the amount I owed, Sierra Collections & Consulting LLC has persisted in attempting to collect additional funds beyond what was originally due. Furthermore, they have placed what I believe to be fraudulent or erroneous amounts on my credit report. This false information is being reported on my credit report on a monthly basis, causing undue harm to my financial standing. In addition to these actions, I have also received letters from the agency demanding payment amounts that exceed even those reported on my credit report. These discrepancies suggest an attempt to extract more money from me than what I rightfully owe. I respectfully request that your office investigate this matter thoroughly. I am deeply concerned about the potential violation of state licensing requirements and the impact these actions have on consumers like myself. Your assistance in resolving this issue and ensuring that Sierra Collections & Consulting LLC complies with all applicable laws and regulations would be greatly appreciated. Thank you for your attention to this urgent matter. I look forward to your prompt response and any guidance you can provide.

      Business response

      08/21/2024

      Good morning,

I am in receipt of the complaint regarding Nancy Ferere Harrell.  Thank you the opportunity to respond.

As I stated in an earlier email to you, I was waiting for a response from Richard Traveler, Consumer Services Analyst with the Arizona Department of Insurance and Financial Institutions.  They are the department my active license is filed with.  Ms. Harrell also filed a complaint with them.

I received Mr. Traveler's response yesterday.  This is what  he stated:  You were current all along, we installed a new system and all licensing information had not been entered.  We apologize for the inconvenience.

Regarding complainant's assertion claiming my license may have expired, per my 3d paragraph above, my license was NEVER expired, I am a licensed collection agency in Arizona.  Complainant can contact Mr. Traveler direct if they need to confirm this.

Regarding paying their debt, a history of her account is as follows.  Her account was assigned to my agency 03/06/2020,  For the next 5 years she was sent 5 letters to her current address and 5 voice mails to her mobile phone asking to respond and either set up payments or pay in full.  Not once did she respond to our communications.

It was not until April 22, 2024, I finally received a credit bureau dispute which I responded to the same day.  Complainant's assertion false information was being reported to the credit bureau is inaccurate.  She chose not to pay her invoice.  On August 12, 2024, John Harrell, husband of complainant, contacted the billing department of our client inquiring about how to pay her debt.  They advised him to contact our agency and offered to provide our contact information, he declined.  August 14, 2024, our agency received a certified letter in the mail with two checks from debtor paying in full the current balance.  The fact she chose not to pay her debt those 5 years was her choice.  Regarding being informed by the AZ-DIFI our license was expired, that is on them.  Had they updated their current software correctly, we would not be having this conversation.

In conclusion, there was never any false information being reported to the credit bureau and as stated above, my license was always ACTIVE.  Our agency will report their payments in full the first business day of September 2024.  According to the credit bureau, it usually takes 30 to 60 days to post their payment.

      Sincerely,

      Mike Barker, Owner

      Sierra Collections and Consulting LLC
