**** and his team put my pool in, had some issues did great at coming and fixing when I advised issues. Now seems like he just doesn't care, I did advise him the pool light is not working, not even 2yrs old, really only have swam one summer, but **** (owner) stated he would put me on the schedule (December) and no response since then. This light should be under warranty, but have not heard a word, hope nothing else goes wrong.Business response

Abbot has been taken care of her light was a manufacture defect which had nothing to do with our work. We had no missed calls, messages or emails at the time the complaint was made. We have replaced the light and things seem to be better now.Customer response

Feb 01, 2022 - Magic Matt *********************** LLC opted me out of contract due to financial/health reasons. I mailed Notice of Cancellation (which was blank as far as dates to both Contractor and then to Owner as well) Since them i have only rec'd false statements, texts, voicemails of the return of my funds from both Contractor, ******************* and Owner, ***********************, employee ********. Installments of $5,000 and now recent phone conversation and email from Owner, **** of $1,000 monthly increments which were to begin August, 2022. To date, nothing has been rec'd. Latest transaction of the $1,000 installments were to be done by ***** for initial $1,000 and for Sept, 2022 amounting to $2,000. My written attempts of both a Registered ltr returned to **** "address unknown" and attempted again to another address by Certified Mail which I do not have confirmation of receipt by addressee. Both attempted addresses were achieved from company's website. I have not been given address where fiberglass pool shell was ordered or is being stored and now I have no physical address. Three cks were issued $24,575 (Pool Shell), $1,000, initial downpymt for permit (which Pinal County does not have record of receipt of app of permit for pool installation) and $2,000 for an auto vac cleaner.Business response

*************************** entered in to contact with Magic Matts Pools LLC in November of 2021. At the time she signed her contact she was made aware that there is a 72 hour right of recission. She was originally in contact with *************************** who was the salesman at that time. In August of 2022 we were made aware by ***** of her health situation and that she cannot finish out her contract (currently has a open balance). Her pool was ordered and paid for by Magic Matts and there are no returns after the 72 hour right of recission. At the time of the original contract, we ordered and paid for her pool which had to be delivered from its manufacturer in ********** with an additional delivery fee of $9,782.24. To date her contact has costed us more than she has initially paid. We offered to try to sell her pool for her to refund the money, which to date has not happened. We have had 3 people interested in the pool,but nobody has been placed under contract as of today. Despite the constant harassment and negative reviews from ************************ has agreed to let her out of her contract which he is not under any obligation to do. However, we still cannot return her pool. He offered to deliver her pool shell to her, but she declined. ***** said she does not want her pool shell, therefore there was a verbal agreement made in August of 2022 to start making $1,000.00 monthly payments on or around the 15th of the month. We have had some difficulty getting the payments to ***** but a monthly payment has been made every month, September had 2 payments to make up for August. To date ***** has received $7,000.00. We will agree to continue the payments however the continual harassment and defamatory remarks from ***** need to stop. No more communication outside of normal business hours and we would prefer communication to only be through the BBB for the remainder of $17,575.Customer response

only have trouble with them paying me on time without knowing when they pymy will be sent. I accept to resolve on condition that I can at least get monies on or before due date of the 16th. If pymy is to be late a notification would definitely be appreciated.Customer response

JUNE 7, 2023 - I haven't heard anything from your office since this was forwarded to you on May 31, 2023. Can you please let me know if you have contacted Owner, **** of Magic **** Pools, LLC. They have ceased paying my the monthly installments and I would like to reopen my complaint/case # ********. I can't contact them since this was in the agreement to resolve. You should have the Resolution closure on file as I wasn't able to retain a copy. I didn't want to close this but you gave me 30 minutes to respond and I was in dental chair at my dental office and didn't respond in time and the complaint was closed as an agreement by both parties. Each month I had to remind them, and each month there was a different excuse on sending me installments. They called this harassment on a personal cell # which is the cell # I was given by employee, ********, to use to report directly to her with any problems. I assumed this was her work cell #. Now, I cannot call and they have ceased sending monthly installments. Now, I am without my monies owed me and I don't know if or how I can contact them.Business response

We have not ceased payments, we mailed a check as ************* is doing away with popmoney. To date the check we mailed has not been cashed. I can send a new check but it won't be until I get back in town as there is not a ************* in ****** and I don't have my checks with me. Please confirm that you would like for ** to stop payment on the check mailed 05/19/2023. We will hold the June payment until we know if we need to resend the May payment.
