      We are seeking a remedy for shoddy or non-existent repairs to the window in the home we recently purchased. According to the seller’s real estate agent, David & Jane Hodges, had 4 picture windows measuring 69” tall x 45” wide replaced under contract by Tucson Glass and Mirror Co. on February 22, 2022. Tucson Glass and Mirror represented to the Hodges that the windows were covered under warranty for 25 years. The house was listed for sale in March 2022. We bought the house & moved in July 23, 2022. On July 25, 2022, one of the widows began fogging up between the panes. Currently, water condenses and drips down between the panes. What we bought was a beautiful living room panorama view of the Santa Catalina Mountains. What we now have is a grotesque blob facing our living area. We first contacted Tucson Glass and Mirror July 28. Tucson Glass and Mirror refused to respond to repeated requests to discuss this issue. Tucson Glass and Mirror repeatedly promised to supply information about the repairs but failed to follow up. We were told they would provide the invoice for the repairs which they failed to provide. The complete lack of cooperation suggests that the repairs were never performed. Tucson Glass and Mirror knew that the house was for sale. They also knew that the Hodges were absent. What Tucson Glass and Mirror sells as a product completely trouble free for 25 years failed after 5 months when the monsoon rains began. The ability to claim redress as a third party beneficiary is well established in Arizona’s Uniform Commercial Code (UCC) and caselaw. Examples include ********* * ******* and Treadway v. Western Cotton Oil Etc. Co., ** **** *** ****** ****** This is sound policy, as there is no need to drag the sellers into a dispute solely so that they can blame Tucson Glass and Mirror for the repairs that were intended to benefit us.

      First, our apologies for the delay in response, however the letter mailed on 7/14/2023 was the first time we became aware of this situation. Upon receipt of this letter, we searched our records and have no invoice or record of work completed for David/ Jane Hodges or Bruce Clark, and we have not received any phone calls regarding this issue. We also do not offer 25-year warranties.  After reading the customer’s statement, we reached out to Mr. Clark to get more information and clarification about his complaint.  He provided us with the full address of ***** ** ********** ***** *** ******* ** ******  We do not have any invoices listed at this address.  We asked Mr. Clark to clarify the work done and he believed that the whole window, frame included, was replaced on this job.  Tucson Glass & Mirror Co, Inc. does not replace or install framed windows. We only replace the glass.  We also ask if he had the original invoice number or if he could provide us with the phone number for the original owners/agent so that we could further investigate this matter.  He was unable to do that. We are always willing to help and assist our customers resolve any issues or concerns that may arise.  After talking with Mr. Clark and having no records of the customers or property listed, we believe that Tucson Glass & Mirror Co, Inc. has been mistakenly named in this complaint. We often receive calls from people confusing our company with various other companies (e.g., Glass Works of Tucson, Tucson Window and Doors or Window world of Tucson) to name a few)
