************** filled out and signed a credit application to apply for credit to finance his purchase of a tax service from ************** a tax service company. His application for credit was approved by Tax Rise.  The financing was accomplished through a retail installment contract (RIC) he executed with Tax Rise.  That RIC was subsequently assigned to Home Acceptance Corporation (HAC).  HAC purchases RICs from numerous service companies and retail merchants in several industries.  Our role is to provide financing to businesses so that they can offer financing to their clients, such as *************.  ************** was sent notification that his RIC had been assigned to HAC.  The notice requested ************** to inform *** if he had any dispute with the assignment or any information about his account within 30 days of the date of the assignment notice. ************** never submitted a dispute.  As he states, ************** made several payments to HAC to be applied his RIC account. We have contacted Tax Rise on **************** behalf and asked them to contact ************** to provide him with a status and progress report of their work for him. HAC has found Tax Rise to be a very professional company that vigorously works to achieve the best results for their clients.  We have asked Tax Rise to keep us informed of their effort.  If ************* does not receive a response within a reasonable period of time he should call HAC and we will take steps on his behalf to escalate his request with Tax Rise.

We do not show a person with this name as a current or former customer.  We searched our database for entering a query for her name, the telephone number listed in the complaint and the email address listed in the complaint.  There was no customer with that information in our database.  Her complaint did not list an account number or any additional identifying information such as a social security number. She did not attach a copy of the trade line information on her credit report which she filed her complaint about.  We have tried to contact this consumer at the phone number and email address listed on the complaint.  But she has not returned our calls or replied to our email.  It is possible that the consumer had an account under a different name and phone number.  Unless she contacts and provides additional identifying information it is not possible to address her complaint.

We had a payment plan with Home Acceptance Corporation, for a ** and a software that started on October 2021; so my son can use it for school purposes; back on April 2022, a representative called ***** from such company came to our home and we returned the ** and the software to her (same way we obtained the goods), I signed a document proving I was returning the two items and she said there was no pending balance with Home Acceptance since we were returning the goods. Unfortunately she didnt provide us a copy of it; now that account is listed as PAD and Closed with the 3 credit bureaus, but for our surprise, this year, I received a letter from an attorney office requesting me to pay for the items we already returned to Home Acceptance through their employee; I feel aggravated because everything has been returned, and supposed to be cancelled, and we received a letter requesting us to pay for them when we don't have anything in our possession. My wife contacted Home Acceptance and they requested us to contact their employee to ask for the proof that we returned the ** and the software, when they supposed to be the ones responsible to check their records, and to verify their workers reports. Please see attached a copy of TransUnion and Experian reports of how the information is listed from Home Acceptance Corporation, as well as a portion of my credit report showing the account listed as PAID Charge off; as well the letter I received stating the account will be transferred to a law firm for recovery. I feel is not fare to pay for something has been returned already.

**************** purchased a computer and software from a retail merchant, Rivieras System, Inc.  ***** is the owner of Rivieras System,Inc.  He chose to finance his purchase and signed an installment contract with Rivieras to do so. Rivieras System,Inc.  assigned that contract to Home Acceptance Corporation (HAC) to bill and receive his payments.  When he stopped making payments his contract was charged off.  After that **************** apparently turned in the merchandise to Rivieras System.  Home Acceptance was never informed that the merchandise was returned to Rivieras System.  We spoke with the merchant and confirmed that the merchandise had been returned.  Therefore, HAC has ceased all collection activity and will submit a request to each credit bureau to delete his trade line.

This is a valid debt owed to Home Acceptance Corporation.  On March 2, 2017 ****************** applied for credit to finance his purchase of a set of 22 rims and tires from a retail merchant, ************, ****  After signing and submitting his credit application, his credit application was approved.  ****************** then signed and entered into a written ********** Security Agreement to finance his purchase of the rims and tires.  The amount he financed was $1,839.48.  The terms of the written ********** Security Agreement called for monthly payments of $107.63.  Shortly after he completed his purchase from ************, ***** ************, **** assigned the executed ********** Security Agreement to Home Acceptance Corporation. ****************** was sent written notice of the assignment by both Home Acceptance Corporation and ************, **** He was also notified by telephone and was sent monthly billing statements.  The next month, in further acknowledgement of the assignment and the validity of the debt he owed, on April 11, 2017, he made one payment of $107.63.  He never made another payment after that. The balance of the contract is owed to Home Acceptance Corporation.

I had a loan with home acceptance for a total of $3800 that was auto drafted from my checking account successfully for almost two years. In December 2022, apparently I had a returned debit for *** in which I was charged $34.96 which was the only *** I had for the duration of the account. The payment was drafted successfully the next day. I assumed the *** fee would be auto drafted just the same as every other payment had. Instead, more than a month after the final payment was made, my credit score dropped over 60 points because the company neglected to draft the *** fee or notify me that it wasnt drafted and was still owed. I reached out to the company asking for a courtesy deletion and paid the past due fee and was given an email address for customer service to request the courtesy deletion. My email was never acknowledged or answered and Ive been met with rudeness in talking to several employees. For me to pay $3800 successfully just to take a credit hit for $34.96 is absurd. Ive been building my credit to buy a home for over 3 years and this issue has ended with me being denied a mortgage loan after being pre-qualified. All I needed was the payoff for this loan to update on my report and my dreams were coming true. I am absolutely devastated. This is so unfair and although I was satisfied with the service once upon a time, never will I ever recommend this company to anyone. I was never notified of the payment not being drafted and assumed all payments would be auto drafted as it had been for the duration of the loan.

      Business response

The consumer gave us written authorization to auto draft her account for a specific sum each month.  She did not provide written authorization to auto draft her account for *** charges over and above that amount.  We do not take payments we are not authorized to take.  Just as her banking institution notified her there was an overdraft, we sent her a statement showing the charge had not been paid.  We also provide her access to view her account in real time 24/7 through our web portal.  Whats more, her banking records would have shown that no additional payments had been withdrawn from her account to cover the *** charge.
The consumer telephoned us to request a pay off quote for the balance of her account, She also requested a courtesy waiver from us to clear up her payment history saying she unwittingly hadnt made her payments because she thought it had been paid through auto-pay.  We provided the quote and the consumer paid the balance of her account on March 10, 2023. At that time our representative also obtained approval for the waiver.  The representative spoke with the consumer and informed the consumer the approval was granted and that we would request the credit bureau to amend the consumers credit history.

When we request the credit bureau to amend a consumers credit history, the credit bureau requires a specific format and requires that we submit the request at the end of the current reporting period along with our regular reporting submittal.  The soonest that our request to the credit bureaus can be transmitted is April 7, 2023.  On that day we will submit the request.  The credit bureaus generally amend the record either in the month it is received or the next month.  If the consumer notifies us that her report has not been amended within 60 days, we will again do everything we can to push the credit bureaus to amend her credit record.

********************** applied for a loan with our company. He explained he had a family emergency and wanted a personal loan.  He stated he had a good paying, steady job. His credit report showed a few trade lines in good standing.   He filled out and signed the credit application and all the loan agreements.  On September 29, 2021 we took a chance on him and made him a personal loan.  His first payment was due on October 29, 2021.  The personal check he remitted for the first payment came back NSF (non sufficient funds).  We attempted to reach him by telephone.  He changed his phone number.  He never notified us of his new phone number or new address as he promised in writing he would.  We sent billing statements and reminder notices to him.  He never contacted us and made a single payment on the money he borrowed.  In January of 2022, 3 months after borrowing the money and not having made one payment or even a partial payment, we received notice he had filed a bankruptcy petition.  As soon as we received the notice, we ceased all communications with him.  In March his bankruptcy was discharged.  We correctly reported each transaction with his account to the credit bureau.  As someone who is obviously familiar with evaluating his own credit report, he should not be surprised that failing to repay money he borrows and then filing bankruptcy to discharge the unpaid debt negatively affects the score he receives from scoring companies like FICO.  Home Acceptance does not control a persons score.  We simply report the facts. The likelihood that other creditors choose not to do business with him based on his credit history with us is a consequence of the choice he made.

Home Acceptance stated they did not know where I live but they were sending people to my residence to look for me

I spoke to  A guy from Home Acceptance on January 6 and 10 of 2022 to get a payment extension and they wouldnt give it to me they send  a guy to my house looking for me and asking for information and leaving paperwork from Home Acceptance I changed my phone number because Home Acceptance was harassing me with phone calls  and also contacting other people to ask them for me if the guy from Home Acceptance did not report that to the company that I spoke to him twice thats not my fault because of the harassment and they sending people to my residence I decided to file for bankruptcy because they wouldnt stop harassing me with phone calls and emails .

      Business response

      10/24/2022

Just as he did not make any payments, the consumer did not inform us of his phone number and address change as he promised in writing to do.  Only through the references ********************** submitted in support of his loan request were we able to contact him in January 2022.  At no time during the intervening three months from the date he obtained the borrowed funds did he make even a partial payment.  Nor did he seek to make any alternative payment arrangements or make a request to restructure his loan.  We were certainly willing to make all of those alternatives available to him.  Instead, ********************** chose to pay not one cent toward the money he borrowed.  Instead, he chose to ignore ** and dodge his obligations.  If at this time ********************** would like to make payments on his loan, pay off his loan or come to some other settlement with us with respect to his loan, we will certainly report that information to the credit bureaus.

I tried to make a settlement offer to them by email I never got a response from them at all they had my mailing address where to send letters they did not do so instead of that they send people to my residence to look for me and ask family member for  information about me The harassment continue nonstop from Home Acceptance Corporation like I stated I contact them A guy answer the phone I requested for a payment extension they denied the request by phone now theyre trying to come and say I didnt make a effort to contact them when thats a lie if they wouldve accepted the settlement offer I sent them by email we wouldnt be here going back-and-forth when I did contact them for a payment extension by phone they deny that request they had my residence address The phone number I had change it due to the harassment they were doing to me Home Acceptance

I am on automatic billing. they bill the same amount month after month and I have proof they billed me and the charges went through yet they reported it on my credit that I didn't pay for 30 days. This company is very rude when you call and no one seems to be able to fix the issue or remove it from my credit.

Ms. ********* account was set up to be paid each month by automatic billing as she correctly states.  And we did receive her payment.  However, the date that was set up for the automatic billing to take place was after the grace ****** on the contract she signed with the merchant. As a result her account incurred a late charge which caused her installment payment to be reported late to the credit bureau.  As an accommodation to her we have reversed the late charge since there may have been some confusion when the automatic billing was set to run.  Additionally, on the next reporting cycle we will also correct the reporting on her account so that her account does not show a late payment.  We apologize for any inconvenience this may caused *********************

This company is predatory and should not be able to operate. 1st I was charged $4225 to file 3 years of taxes and get set up on a payment arrangement which has not happened yet. The lender they use Home acceptance corporation is reporting the loan as a secure loan on my credit report, as if I have furniture or a car that can repoed, which is inaccurate. I sent in email on 4/27 to the company regarding credit and an update invoice since I was being overcharged. I also sent a written notice to remove my card ending in **** from there system and my account continued to try to be debited illegally with revoked authorization. This is a scam. I want a fully refund and a block of any credit reporting from this company.

This consumer purchased services from a merchant, Community Tax.. The customer chose to finance the services she purchased rather than pay cash up front.  She executed a financing contract with them.  Community Tax sold contract to us.  The written contract calls for $4,225.00 to be financed with monthly installments of $226.76.  A copy of the contract she signed showing the amount she chose to finance is attached.  The amount is stated on large boldly outlined boxes on the face of the contract above her signature.  She executed the contract with Community Tax through DocuSign.  She was and continues to be able to access a copy of the contract she signed at all times to review exactly what she signed.  Community Tax provided her with three business days to review the contract, share it with any advisors, make changes or simply cancel for no reason without any penalty before they sold the contract to us.  We simply billed the contract exactly according to the terms of the contract she signed.  She can look at the contract she signed on her DocuSign account and compare it to what we billed her. If she feels the work done by Community Tax was not worth what she agreed to pay, we understand and are confident Community Tax would be happy to discuss their fees with her. With respect to the billing however, we have billed the account exactly according to the terms of her agreement.

We reached out to Community Tax to get any clarification from them.  According to the written agreements with them the customer paid for an analysis of her tax issues and then, as she states, the preparation of three years back tax returns. She financed $4,225.00 of which she has paid five installment payments of $226.76.  Please see the attached financing contract she signed with Community Tax.

Prior to receiving this complaint we attempted to contact ******************** by telephone, text and email.  He did not return our calls, texts or emails.  On the one telephone call we did reach him after a few brief words, he hung up.  After reviewing his statement we conducted an exhaustive investigation of our online portal as well as any company email accounts and any email accounts associated with any of our employees.  We also reviewed the record of electronic and verbal communications we had and attempted to have with ********************.  We found that no documents were ever uploaded to our online portal or were sent to any email address associated with the company or any of its employees.  We attempted to reach out to ******************** to determine what mechanism or to whom any information was sent.

His response was that another company had given him a loan by only accessing his bank account and that we should give him a loan using the same method.  We informed ******************** that was not our underwriting methodology.  He then said if we did not give him a loan he was going to *** us.  The conversation ended.

We provide personal loans to customers that are customized to their individual situation.  Our online application along with other information helps us determine the best program we can offer at the lowest interest rate to the consumer.  Other companies offer more cookie cutter programs at generally higher rates and perhaps do not require much information from the consumer.
