I went into able properties 04-16-2024 at 3:30pm. I paid $40 for an rental application ******************************************. I completed everything before I left and they verified my information successfully. I went to see the property and it was NOT ready as of today 05-16-2024 it is still NOT ready. They asked me to come in and drop off the deposit to lock in the property which I declined to do so as their property was NOT ready. I asked for them to call me back when it was ready and they assured me after speaking with management it would be ready by 05-15-2024. The manager was very rude and at first so was both the reception ladies but they became more friendly as we talked more. I called a few days after like 04-25-2024 and they told me someone else dropped off the deposit and the property was off the market. I checked back over the course of a month to see if they had any other ready move in property and they did not as all of them had "pending applications". I called today and asked about the same property 05-16-2024 as it is back in the market on their website and according to them still NOT ready they want another $40 to verify my information at is has been past 30 days. ?????? I asked the lady ******* if she could call me back and verify with management that I did have to pay again and she did not. I want my money back I also want money back I wasted in gas and leaving work early. NONE OF THEIR PROPERTIES ARE READY to move in and that VIOLATES California law in regards to collection of rental application fees. "Refrain from charging fees if there are no rental units vacant at the time of application. If the landlord uses the screening fee to obtain a tenant's credit report, they must provide a copy of the report upon request (California Civil Code 1950.6).Jan 12, 2024" Very unprofessional, rude and breaking California law company. I hope if I at least dont get my money back others don't fall for their scams.Business response

It is our policy to market properties as soon as we know that they are going to be available.
Occasionally situations beyond our control arise such as former tenant not moving as agreed or maintenance issues
We are sorry that occurred and refunded the application fee

I am rejecting this response because:
They did refund my money but they wasted my time and only after I reported them did they return my money. I want this to stay public so other people stay away from them. The property was never ready these people just collect rental applications and never rent anything out. California law states you will NOT collect an application fee if the property is NOT vacant or ready. Follow the rules be respectful and think about the people needing a home not the money your making you won't stay in business long that way.Initial Complaint

I am having issues with the manager *******. I had to use my rights for rent relief through the Kern County Housing Authority. I live in the small community of Bodfish, Ca so Able basically has a monopoly in rental properties. To make a long story short they have txt msg me that they excepted my back rent and would not proceed with a eviction. After excepting payment they say I have 60days to leave the property because owner wants to sell property. She says I was served a notice on August 22, 2022 at property and in the mail. Which I have not received.******* the manager has a personal bias due to a man we have in common. So she is refusing to work with me, won't take my calls, or return them. And refusing to show me copies of documents filed informing me of tenant 60 day termination. And is being not only by law legally discriminating to my character to due disability and low income. She is also personally attacking me because of jealousy over a man. It is a bizarre and petty immature situation. But my rights are being violated I can't afford a lawyer. And because of the small community is exploiting her power position to control and infringe my rights. I need help in letting the owner know what she is doing and is aware of her discrepancies and if the owner really wants to sell the property. I have not been given a just cause for termination. and according to California Civil Code 1946.2 my situation falls into the no-fault cause in which the landlord must pay for my relocation cost please help.Business response

I am rejecting this response because: It's not true at all. I can prove it. I have been told ******* is the manager of Able this document says Don. I don't believe the owner has ordered a 60 day termination of tenancy. I still believe their is discrimination on behalf of this company it's all a personal retaliation by ******* only. If *** is the owner manager of Able I bet he knows nothing about this compliant. I want to contact owner of Able and owner of property because I know they don't have a clue. if they do I want to know why all of a sudden this decision was made and I also want to know how long ******* has been employed here. I have been stocked and harassed by this girl personally out side Able. She must be a new hire because I have never heard her name in this office until recently. Her famous motive and defense when police are called due to her bad decisions to stock me. Her main objective has been convincing people that I am mentally ill and it's a mistake and identity. It is the furthest from the truth, I am of mind , body, and sound. No history what so ever of any mental illness ever. This girl has ruined my reputation with this, Defamation of character" I want her stopped its gone on far to long. I have never had any problems what so ever with this company they have been very good to me until recently when I was told ******* was the manager.
