On September 7, 2021, Contractor************* of Glowtex Builders and I entered into a construction contract: he agreed to complete to build my house according to approved ********************** building plans for a "not to exceed" price of $1,060,494, as described in the attached contract. Contractor has already collected from me or caused me to spend $1,132,989 on labor and materials included in the contract (Attached Items 4, 5, and 6), which already represents $72,495 in excess of the contract price. Contractor still has not completed many of the items in the contract. In particular, the items not completed include: a. Site concrete, including drive, steps, walks, hardscape. b. Finish carpentry; interior doors, trims, moldings (labor and materials). c. Insulation d. Drywall (labor and materials), smooth finish e. Cabinets (labor and materials) f. Finish electrical labor and materials g. Finish plumbing, hook-up to city meter, feed to fire sprinkler. h. Interior paint (labor and materials). i. Exterior paint (labor and materials). j. Air Conditioning. Despite having collected more than 100% of the contract price of the project, Contractor has abandoned the project and is refusing to complete the outstanding items unless I give him hundreds of thousands of dollars more. Contractor deliberately and continuously defrauded me out of tens of thousands of dollars by telling me that he is paying the workers on the project certain amounts, while he was simply pocketing a large portion of that money. 6) The Contractor continuously and systematically neglected his duty of overseeing his employees and managing them to ensure full days of productive work. Out of 232 working days, Contractor appeared on the project only 72 days, and remained on the project for the entire workday on only 16 days. As a result, his workers often worked incomplete days, worked slowly, inefficiently, or not at all.
