On or about April 8th, 2022, our next door neighbor began excavation in her backyard, for the purpose of a pool build, using Pool Diggers, ********************************. Immediately, Pool Diggers began to repeatedly trespass. Within several days, we noticed that our large 7 year old Lavender plant, situated in our side yard, was completely destroyed with its roots exposed. We reasonably surmised that the mini Bobcat Pool Diggers used to excavate the neighbors backyard, (driven back and forth between houses to transport dirt and debris), trespassed onto our property causing harm to our plant and drip line. Pool Diggers did not provide notice to us that it destroyed the plant or anything else, but when we saw the damage to the plant we contacted Pool Diggers, in writing, and demanded compensation. Our letter explicitly informed Pool Diggers that we would use a landscaping company to provide an estimate and perform the work. Our correspondence went unanswered. At the end of excavation, ******* discovered a crew member in our side yard with a shovel digging up our damaged plant without consent. she promptly asked him to leave our property and told him that we wanted a company response, in writing, to address our demand. The crewmember respectfully complied and left the premises, Subsequently, we sent a second email to Pool Diggers on April 21st to remind Pool Diggers that we had not consented to Pool Diggers entering our property for any purpose nor had Pool Diggers responded to our email. Our landscaper of over 8 years provided a fair and reasonable estimate to restore us to where we were before Pool Diggers destroyed our property although we are not sure what was done to our dripline. The plant estimate is included in this BBB complaint. Thank you in advance for looking into this matter.
