On September 29, 2021, I walked into Burbank Ammo & Guns on ********************************** XXXXX with the intent to purchase a firearm. I spent two hours there talking to a sales representative and never did he verbally mention a restocking fee of 25% if I decided to not purchase the gun. I never walked out of the store with any product in hand. Fast forward to today when after multiple phone call attempts finally someone picked up the phone. I asked for my money to be refunded *** (claiming to be a supervisor) said they were going to deduct 25% before I get refunded, I told him **** ****** (sales person) never mentioned this so I could make an informed decision before hand. *** said it is written on the receipt, which I only have a credit card receipt and does not show any information pertaining to a restocking fee. I also have a "Dealer's Record of Sale of Firearm" that also does NOT state any restocking fee of 25%. After I asked to speak to the owner, he refused to give me a direct contact number and instead gave me a general email address and proceeded to hang up the phone. I'd like to file a formal complaint against the business and business owner, **************, to recover the full amount charged to my credit card of $726.25.

Business Response /* (1000, 5, 2022/03/10) */ ************************************************************************************************************* On September 29, 2021 you initiated a purchase for a firearm. You left with no firearm on that day in accordance with California law which requires a 10 day waiting period. On October 6, 2021 The CA DOJ notified us of your ineligibility to possess a firearm. Multiple voicemail were left at the provided number. One was left on the same day by the original sales associate who assisted you. We received an email from you on Feb 11, 2022 requesting the refund in full. A follow up to that was received March 10, 2022. A copy of your original invoice shows your initials and signature agreeing to the terms and conditions of the transaction including the industry standard cancellation fee. It is our standard practice that every customer who purchases a firearm is notified verbally and in writing on the hand written invoice and register receipt. In regards to the actual refund we are always willing to discuss and assist you with this in person. After discussing the details of this transaction with the owner they have agreed to reduce the amount of the fee to the minimum mentioned on the invoice (in the amount of $50). Please understand this fee is used to cover the bare minimum cost of this transaction with regard to documentation requirements required by local, state, and federal law. Please visit us during our normal hours of operations at your convenience or contact the owner ********************* Consumer Response /* (2000, 7, 2022/03/16) */ (The consumer indicated he/she ACCEPTED the response from the business.) Although, I remain firm that the cancellation fee was not disclosed verbally to me at the time of purchase, nor does it appear in writing on my receipt, I accept and understand the processing fee ($50.00). I greatly appreciate your assistance. Consumer Response /* (3000, 13, 2022/04/18) */ As of April 18, 2022 and after sending an email to **** in charge of the Sales Dept. at Burbank Ammo & Guns, I have heard nothing and have not received my refund. Please advise.
