We respectfully request your help in this matter as the same people that run this shop are associated with the DRE-suspended corporation New Haven Financial Scott Fine, *********, **************, and ************ (servicing company). The servicing company (Platinum Loan Servicing) is owned by the broker and the fund, so huge conflict of interest. The DFPI confirmed the fund control person is not licensed already. We need some help as we have made some reasonable proposals to waive any claims against the dutch interest being charged illegally, and the undrawn $***** but the lender has chosen to attempt to foreclose to attempt to take the houses for our project. We have been trying to refinance since February. We are not willing to pay "whatever" and risk the undrawn $****. They also have a guy named **** that was unlicensed handling fund control, and the DFPI is investigating. Resolution: One solution is a settlement with the lender to pay off the loan in the amount of $**** which is half of the illegal dutch interest they charged as well as a discount for paying over $**** in excess fees that went to their attorney and profit. Moreover, we would need to get corrected 1098 mortgage statements to correctly have the interest we paid so we have the ability to write off the mortgage interest, and a complete and accurate accounting of all the amounts and charges which we've been requesting since the beginning of the loan. The servicer has repeatedly made errors such as charging for interest that is already built into the loan and not providing statements when requested or notifications when payments are due for example an incorrect balloon payment statement that was subsequently rescinded. Therefore the payoff of $**** splits the overcharged dutch interest, the overcharged forbearance fees and attorney fees that were charged to us throughout the loan process. We need help with this expeditiously as we've been waiting since February.Business response

Business Response /* (1000, 8, 2022/07/08) */ Disgruntled borrower. The complaint is a complete Fabrication. The case has already been settled by agreement with the lenders. Developers control is a licensed entity. Because of the settlement, borrower has elected to rescind THE COMPLAINT.
