I created a company known as Copper Creek Records, a label that specialized in issuing bluegrass music on long play albums, cassette tapes, and compact discs. The firm incorporated on March 1, 1995 as Copper Creek Publications, Inc. In 2019, I was contacted by M******* ********* (Garland Entertainment; **** **** **** ******* ***** *****; Ventura, Ca 93003; Phone: ###-###-#### who expressed an interest in purchasing my company. Over the course of several phone calls, he offered $35,000, then $40,000, and finally $45,000. In addition to the offers for the company, Mr. B******** expressed an interest in purchasing other record labels and offered me a finder’s fee of $2,500 for each firm that I brought to his attention and which resulted in a concrete sale/purchase. I did not sell my company to Mr. B******** but I did deliver the names and contact information for six other record labels, one of which did result in a sale/purchase. I received $1,000 towards my finder’s fee and then an explanation that his end of the deal was not as lucrative as he thought it was going to be and asked if I would be willing to call it a done deal with the $1,000. I told him no and that I would like the amount we had agreed upon. In time, he sent additional payments of $100 and $250 and then the money stopped all together. On September 3, 2021, I reached out to Mr. B******** to see about the remaining balance due to me. I received no reply. I reached out again yesterday, September 28, and received a reply that he had not received the September 3 email. He then attempted to reframe his original offer, which I found infuriating: “Your fee was based on bringing labels to the table we could purchase. You brought 6 labels to the table and only one closed. The rest of the labels were not interested in selling, even though you said they did want to sell and that you would help close the deals.” He then added: “Here is what I propose. I’ll give you $200 and let’s call this a day. The company has long since closed down. I certainly didn’t get what I had anticipated.” In offering me the finder’s fee, Mr. B******** never suggested that it was contingent on how well he profited, or didn’t, from the deal. I’m sorry that things didn’t work out as he had anticipated but I don’t feel I should be penalized because he made a bad deal. In short, he made me an offer and I did what was expected of me.
