we have reached out to this gentleman. i believe that we have resolved the problem with his mail not getting delivered.

we have tried calling him many times, as we are also anxious to get the form DL389 to him.

today he did call us back. we decided to send him a third form, registered mail.

we are both hoping that this will be the successful conclusion to his issue.

i won't go into detail about the entire transaction. but to summarize, we explained everything to ******************** when he purchased his motorcycle. and, our business manager ******************* also e mailed him several times and further explained all details to him. he does not respond to our questions, nor has he returned the expired plate that we sent him a pre-paid envelope for.  We are done dealing with him. he has been rude and uncooperative at every turn.

Now to address his refund request. we are going to issue a $300.00 refund, but it will not go to him. He neglected to inform you that he took out a loan with ************************* services when he purchased his motorcycle. They are the lienholder of record. So, any refund need to go to them. Which is EXACTLY WHAT WE ARE GOING TO DO.

We have been polite and professional, he has not.

That is all that we can do from here. Please contact me directly with any further questions.

My complaint file #******** was responded by you stating that the file for the reason that I did not state a resolution. I write to ask you to try one more time. The resolution is that the dealer put back all of the parts they took off my motorcycle. The second part is to test the motorcycle to start normally. For you knowledge, the motorcycle was dropped off with front end damage and I have pictures of it "in as is" condition. But this dealer decided to go under the seat and remove electrical components. Decided to remove parts like the oil caps, gas caps and leave the bike in the rain. They decided to take off the complete rear end fender with all parts attached including my license plate. The resolution I seek is to get the motorcycle in "as is" condition left with the dealer service manager. Update. The owner had called me, but refused to discuss a resolution with me or my attorney.I want to speak with your president. And i want you and everyone to know that I have had the experience where a state official did not take my complaint seriously. I took it to the Governor who inquired about it. The state official, a commissioner, was fired. Please take a look at my motorcycle. I am willing to pay for your service and time to do this.Thank you.*********************** ************

************ leaves ot a lot of details in this complaint.

Detail #1. This bike was dropped off to ** wrecked on November 7th, 2017.

It was here for over seven calendar years. and over five actual years.

************ received the payment from his insurance company, yet never brought any money in to have us perform the repairs. He kept the money, and left his bike sitting here.

Please find attached the repair order/estimate sheet that ************ signed recently when he came to our store. As you can see, we waived over $27,000.00 in storage fees, as we did not want to preform any work for him at this point. we were also never paid for the wreck estimate, or our wasted time and energy. he signed the document that said he agreed to take his bike, and the loose parts we had, and that we would waive all fees. So, it appears that ************ does not intend to honor the agreement he signed. That being the case, he will owe us close to $30,000.00 for all of his accumulated fees.

We have a ton of other documents, including the second one attached. We delivered the bike back to him recently, and he locked his gates and refused to let our employee leave his property.

We do not want to do any business with ************. Nor do we want to be hassled and insulted by him. He was presented with repair and storage bills several times throughout the years, to no avail.

The fact that he left his salvage bike here for over 5 years is in itself beyond the norm. We probably should have forced the issue years ago, but he did call occasionally, and he came in once or twice. So, it dragged on forever.

The only thing we did wrong was to allow this to drag on for so many years. If he continues to pursue us, we will then pursue him for the amount owed to date.

I am rejecting this response because:

I am rejecting this response because: I am including the pictures of the bike.  Picture 1 is as dropped off by Geico at the shop. Picture 2 and 3 are as delivered in the court yard.
As it sat in my courtyard I had a conversation with *****, the service manager.  I shared with him that my bike is missing parts.  He asked which ones and I started to go over the list.  He then interrupted and told the driver to bring back the bike.  He told me he was going to auction it off.  The bike was loaded.  I told the driver I am going to close the gate and calll my attorney.  After speaking with my attorney it was decided that the bike be kept and the dealer be sued for breach of contract.  The bike was unloaded by the driver and the gate was opened.  No threats were made as it is illegal to do so or hold any person.  That would be hostage taking.  The driver was very kind and went on his way.  ********* was called.
As to the dealers rest of the false statements I will make the following statements under all applicable laws.
The bike was left with ***, the service manager at the time.  I got $8500 from the insurance, but the estimate was above $9,000 for repairs.  I offered the money, but I was told to wait until I had the full amount.  *** told me that I can leave the bike until I get the repairs.  The exact language is that we take care of our customers.  No time or amount of storage fees were ever discussed or billed to me.  I want the business Burea to know that I have a residence on two acres and storing my bike at home was not an issue.
*** is no longer the service manager.  He will be called to testify when I do file a case against the dealer in court.
Brain, the service manager, was visited over a year ago.  I wanted him to give me the amount to fix my bike.  I was there with *************, a neurosurgeon as witness and I also met a gentleman there that worked previously for the dealer in *********.  The truth is Brain never got back to me.  I called several times and left messages with other staff, but no one called me.
It is only when I wanted them to fix my bike or return it is when I got an apppiintment to meet at the dealer.  The owner, his son, another staff member, and Brain met with me.  The estimate I was given them was about $16,000.  I was told the costs have gone up.  I asked them to fix the front end where the damage was.  Brain talked some more and told me how he has to get a second market fender and paint it.  $1500 was the cost for that.  Brain went back and made an estimate to fix the front end and came back with about $7,000. I agreed. Except he wanted another $1,000 so he didnt have to call me if he needed a nut or gasket so work would not be held up with him trying to call me.  I asked him to go over my bike with the list.  There is a part I did not need, and he said he would not fix it without it.  The owners son then said that he will deliver my bike and waive any fees.  He didnt even ask for a delivery fees.
Brain had me sign an as is form and in good faith I believed we were finished.
Surely, we were not.  Now it is just the beginning.  Please take a look at the pictures.  Compare the bike trusted in their care and the way it was delivered back to me.
The dealer has completely stolen my rear end.  Destroyed the wiring under the seat and stole equipment.  They have stolen many other parts.  Most importantly, the bike was able to start and needed just front end repair.  I am advised that with the parts missing and the bike parts no longer available that the bike is now unfixable.  This means that this dealer has caused a lot of damage to my bike and I.
Please do not be moved by the dealer's threats.  Please do not give them the rating for people to believe they are good.  This dealer is very very bad.
As for a resolution, I ask that my bike be put back in the condition left with the dealer.  It is only then I can get the front end repaired and ride again.
my bike is available for you to review.
      thank you
