Flex Embroidery owes me compensation for the services not rendered by their business, Flex Embroidery (unlicensed), due to false claims about what services his business could do. ***** (owner) accepted my advance payment of $128 and confirmed he was able to complete a DTG (Direct-To-Garment) printing service for my business, even though he was aware since the beginning of this transaction that he could not complete this service. After receiving my product back and noticing my shirts were printed as DirectTo-Film (DTF) and not printed Direct-To-Garment (DTG), he stated, with a witness present, that his business does not even own a Direct-To-Garment (DTG) machine. Direct-To-Garment printing is the only service I ever expressed any interest in, and I paid him for 20 Direct-To-Garment (DTG) printed shirts. I confirmed multiple times that these shirts would be printed DTG, and he neglected to tell me every time that these shirts would NOT be printed DTG despite my numerous attempts at clarifying. Additionally, he charged me a $50 design fee for having to retrace my design. According to him, the design was not printing properly, so he had to retrace and alter my design. The design would not have had to be retraced or altered if this was printed Direct-To-Garment like I stated I wanted. I tried to settle this informally twice. The first time was on January 31, 2023, when I messaged his business Instagrarn account after I found that he was actively advertising DTG printing as a service he provides on his business cards, website, and ******** despite not having a DTG machine. I gave him 24 hours to send me my refund. He blocked me. My second attempt was when Certified Mail delivered a Demand Letter on February 21, 2023. This means that I tried twice and gave him plenty of time to refund me the minimal amount of $178 before now asking for the total loss of $1,023 my business has endured due to his unacceptable business practices.
