Advertising Review
On September, 19, 2022, BBB requested Speedo USA to modify, substantiate or discontinue claims made on their website (https://us.speedo.com/) that read, “The best options for any swimmer”, "Enjoy up to 80% off" & "Last chance up to 80% off select styles", "As the world's leading swimwear brand..", Additionally, on the business’ LinkedIn (https://www.linkedin.com/company/speedo) it reads, “The world’s #1 name in swimming, Speedo has led the pack for over 100 years..” & “..As the world’s leading swimwear brand..” Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.

BBB's Code of Advertising Section 11 states, Where a savings claim (for example, “save up to 40%”) covers a group of items with a range of savings, the number of items available at the maximum savings must comprise a significant percentage, at a minimum 10%, of all the items in the offering, unless local, state or provincial law requires otherwise. To avoid confusion or any possible deception, an advertiser should consider including a disclosure of both the minimum and maximum savings available under the offer. In such an instance, the advertiser must avoid any undue or misleading display of the maximum. Code of Advertising Section 9 states, The unqualified term “sale” may be used in advertising only if there is a significant reduction from the advertiser's usual and customary price of the products or services offered and the sale is for a limited period of time. If the sale exceeds thirty (30) days, advertisers should be prepared to substantiate that the offering is indeed a valid price reduction and has not become their regular price. Time limit sales must be observed. BBB Code of Advertising Section 28 states, Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests. As statements of fact, such claims, like “#1 in new car sales in the city,” can be proved or disproved. Additionally, BBB Code of Advertising Section 29 states, Expressions of opinion or personal evaluation of the intangible qualities of a product or service are likely to be considered puffery. Such claims are not subject to the test of truth and accuracy and would not need substantiation. Puffery may include statements such as “best food in the world” and “we try harder” as well as other individual opinions, statements of corporate pride, exaggerations, blustering and boasting statements upon which no reasonable buyer would be justified in relying. Puffery also includes general claims of superiority over comparable products that are so vague that it can be understood as nothing more than a mere expression of opinion.

In September 2022, BBB investigated Speedo USA’s business practices. This investigation was prompted by the increase in consumer complaints received by the BBB. Consumers allege the business has failed to issue a refund once products were returned; failed to deliver products within the advertised time frame; some consumers also allege that the delivered products were not the original products that were ordered and some were delivered damaged.

On September 19, 2022, BBB sent the company a Business Practice Inquiry through e-mail to request the following information:
-Process of inspecting returned items and sending refunds accordingly
-Process of how the business keeps track of the reported damaged or incorrect items before they are returned
-Process to ensure the product is delivered within the advertised time frame
