Date on the invoice - 09/23/2021 Requested a refund of deposit of 4 cubicles. Business had taken deposit and had not come through with completing work of cubicles after 2 1/2 months. Originally, it was promised the cubicles would not take more than a month to complete and install. After many excuses on why cubicles were not ready and empty promises, I requested a refund of my full deposit in the amount of $1500. The owner ******* ***** ****** **** signed a promissory note on 12/06/2021, stating a full refund would be given no later than 12/13/2021. As for today, after numerous texts and calls, he is refusing the deposit. I have attached an invoice, promissory letter, and owner's ID.Business response

Efectivamente la compañia Farmers agente (**** *******) entrego un cheque a Kay cube designers por $1500.00 a nombre de Veronica Valencia porque el senor **** ******* se reuso a pagar impuestos.
La order no se completo porque no havia mercancia en ninguna compania. Los colores que el eligio estavan en Back order.
En ningun momento yo personalmente me he negado a regresar el deposito solo le pedi tiempo puesto que nosotros pagamos por la mercancia usando el deposito.
En numerosas ocaciones por medio de mensajes de texto el senor **** ******* me amenazo incluso con el IRS Yo tengo todo en regla con el IRS reporto mis ventas totales incluyendo ventas en cash y tengo las pruevas.
*El senor **** ******* menciona que fueron excusas, no fue ninguna excuxa tenemos los recivos pagados de la mercancia que era para su orden.
******** ****** no es el dueno de la compañia y lo que firmo. Lo firmo con precion y obligado por el senor **** ******* y sin saver lo que firmo porque no habla ni entiende ingles.
*tambien yo tengo un mensaje de el senor **** ******* que me dice que no quiere tener ningun trato con nosotros por eso no hemos llegado a ningun acuerdo.
Estoy en la mejor dispocision.

Indeed, the Farmers company agent (**** *******) gave a check to Kay cube designers for $ 1500.00 payable to Veronica Valencia because Mr. **** ******* refused to pay taxes.
The order was not completed because there was no merchandise in any company. The colors he chose were in Back order.
At no time have I personally refused to return the deposit, I only asked for time since we paid for the merchandise using the deposit.
On numerous occasions through text messages, Mr. **** ******* even threatened me with the IRS. I have everything in order with the IRS, I report my total sales including cash sales and I have the proofs.
* Mr. **** ******* mentions that they were excuses, it was not an excuxa, we have the receipts paid for the merchandise that was for your order.
* ******* ****** is not the owner of the company and what he signed. I sign it with precision and obliged by Mr. **** ******* and without knowing what I signed because he does not speak or understand English.
* I also have a message from Mr. **** ******* who tells me that he does not want to have any deal with us, so we have not reached any agreement.

I am rejecting this response because:
We are seeking a full refund as agreed from the promissory note signed by *******, husband of ***. Throughout the text messages they agreed to refund the full amount. 50% is unacceptable as we also suffered financial losses of over 60-day delay of the promised completion of work and installation. To address their claim of loss in materials is incorrect as material can be re-utilized. We are not seeking compensation for our losses. We hired another company and within 6 days, this other cubicle company manufactured, delivered, and installed the cubicles. The owner of this other company was in disbelief that Kay Cube had not completed the work after 2.5 months. The fact that they are not refunding the money shows their lack of professionalism and mism***gement of their money to the point that it appears to be a scheme, taking deposit and not delivering work. And now they are wanting to refund 50%? Why is Kay Cube even considering 50% refund and offer it in 30 days? We will not be ok with this. Failure to receive a full refund within 7 days, we will pursue legal actions which will incur an additional expense for Kay Cube Designs. In addition, we will report this scam to the proper authorities of Santa *** to protect other businesses and we will continue to warn other businesses on social media until this matter is resolved to the fullest as stated on the promissory letter in which ******* signed.
