I went into contract with this business in June of 2023 for them to secure a location, provide a machine, and get a credit card reader. I was only provided a credit card reader, so I'm looking for a full refund minus the difference for the cost of the credit card reader which was $371. I patiently waited for her company to deliver on the deliverables that she stated will happen within 6 weeks, however, it did not occur, so she initiated the conversation about being prepared to begin a refund due to not being able to secure a location and machine as promised in the contract. Therefore, in the beginning, I tried helping her company (unpaid) by providing her with additional information to help her company in the search which she did not provide me with any results until I reached out to her and that's when she finally let me know she still did not secure me any location as stated in the contract. Therefore, I took her up on her offer for a refund then that is when she told me she will only give me $2,500 which I replied to her via email and told her that this is not acceptable. I want full refund minus the cost of the credit card reader which is the only thing I received from Nayax. I did not sign up to be apart of anyone's market research for free! I was told by her company that they realize her program only works in a few states, so they are discontinuing the program in several states. So, I disputed the transactions with my credit card and I'm making BBB aware because a portion of ******* was paid in cash and so far I have not received any funds from her company as of yet. This is a breach of an unilateral contract she created to benefit her company. I did not receive my deliverables such as machine, location, and nothing was delivered to anywhere since nothing was secured.Business response

After looking into the issue, we are pleased to be able to offer you the following options:
1. We continue our mentorship agreement and our team solidifies delivery of your vending machine and vending machine location.
2. We provide a partial refund, minus applicable fees and expenses required to ****** location leads.We do not offer refunds in our program, as mentioned in the Vending Machine Automation Mentorship Agreement (which is also attached for your reference). However, we want to do the right thing and provide our customer with compensation.
Ill take your lead on how to proceed from here, but I hope one of these solutions will help make up for the challenges youve experienced.

I am rejecting this response because I started this company based on the success rate and the confidence that your company exude stating a location and machine will be provided. However, as you have indicated my area was hard for you to solidify any location, therefore, you initiated the conversation of a refund, so I'm acting upon what you stated. Also, due to your company not being able to deliver on your services the contract is null and void. You have created an unilateral contract that benefits your company only and it does not take into account the consumer when services are not rendered it leaves no protection when services are not delivered as promised. Such as our situation now where a location has not been found nor a machine provided. Also, I was never given access to any of the other services offered through the program such as the tech support by your affiliated partners, the Vending Machine Automation ******************* and the 1 on 1 Group chat team support. I will contact ***** to see if a return can be made since I do not have a vending machine as your company offered. I do not want to continue with your services because your customer service team already told me my area is not eligible for the program after you began trying to secure my location. I assisted you for free on trying to locate a place by providing you with a list of locations including all numbers and addresses which please do not use that listing for other clients. I tried my best to work with you and your company, but you still came back with no results. Unfortunately, you did not do any market research in my area and you did not explain that I was a part of your company's market research either. I did not consent to be a part of your company's market research, so you can now identify my area as being ineligible. Please tell me a breakdown of what you are charging me to constitute a partial refund, I want a full refund as previously stated.Business response

Hello,
We understand that you would not like to choose any of the aforementioned available options to resolve this matter in a timely fashion. For your peace of mind, we have included an attachment confirming weekly payroll for Virtual Assistance hired to source locations. This was for 8 weeks under your program. Other expenses to include marketing, telecommunications, and industry expertise. Please note that per the Vending Machine Automation Mentorship Agreement, signed by *************************** at the onset of our mentorship process, there are NO refunds. However, due to the length of time this has taken, we have an offer for you that we hope will satisfy your concerns.
Offer: We can refund you the cost of your credit card reader, vending machine value, and location value. Plus compensation for the mentorship not going as planned. Total cash refund to equate: $3,000.

I am rejecting this response because you stated you could not hold up your end of the contract, therefore, you told me you wanted to provide me with a refund. Then you blocked all forms of communication with me after not providing me with any refund. So, I'm seeking a full refund due to no vending machine, no secured location, and no access to any of the special ******** groups for paying clients. As you stated you are unable to secure a location, therefore, I would like a full refund. As for the charges from Up work that is ************ research for your company, as you now know not to offer the program in my area which gave your company the ability to tell me I'm not eligible for the program after I waited patiently for my location. I did not consent to be apart of your market research. I entered your program based off of your program falsely advertising you can secure a location for me.

I am rejecting this response because: Rayzo Vending's reply does not resolve nor address my concern of a refund. Therefore, I will be in contact with my bank for much needed results and I will continue to escalate my concern due to the false, misleading, inaccurate, and exaggerated advertisement of Rayzo Vending's "Done for You" program. Also, you noted in your Better Business Bureau's reply that, "if there is anything you would like to share or discuss then please reach out, " however, I had a scheduled meeting with you on September 12th to hopefully meet and discuss with you my refund, however, you cancelled the meeting, so due to that reason I feel I must explore ************* for assistance in this matter.
