      I am not liable for this debt with Capital Collections LLC. I do not have a contract with the collection agency trying to collect and report to my credit report.

      This collection account was assigned 1/11/19.  We did not receive any return mail on this account.  We received a dispute on this account through

      E-Oscar on 11/03/2023.  Our office responded.  Based on the documentation presented to our office,  is a valid debt.  We reported it as a valid debt from ********************.   We did not pursue legal action, as the debtor has large *********** tax liens.  The statute of limitations has expired, the credit reporting will continue until the 7 years expires.

      Ok, just recieved an email from capital collections, nothing by mail, this could be a scam as I have no debt & haven't had a credit card with capital one for 3-4 years now I have no idea what this is about,

      On 02/03/2023 I disputed the completeness and Accuracy of this charge off on my consumer report and it has come back verified. I do not believe that CAPITAL COLLECTION LLC properly investigated this account because there are obvious inaccuracies. Remove this account for inaccurate reporting because the date of the last payment is missing. Since you have not reported the date of the last payment it messes up two things. First, it shows does not help indicate when this account was actually charged off and secondly it manipulates the statute of limitations as I cannot tell when this account is supposed to fall off. This means that you were never given the true date of first delinquency and this is causing me stress being reported CAPITAL COLLECTION LLC has violated 15 usc 1681s-2b of the fair credit reporting act. Since they have verified this account as accurate and there are obvious inaccuracies they failed the 5 duties of a furnisher when receiving a dispute which are all violations from each credit reporting agency they are reporting too CAPITAL COLLECTION LLC has also Violated Cal. Civ. Code *******. They are knowingly furnishing inaccurate information which is a $5,000 violation per credit reporting agency they are reporting to. I also sent them a letter exercising Cal. Civ Code ******* where they are required to correct any inaccurate information from my consumer reports and they have failed to acknowledge my request. I also sent them a letter exercising Cal.       After conferencing with our client, Appliance Resource, here are the facts of the assignment.

       

      On 5/5/2020 Jordan Hopkins entered into a 12 month lease of a washer and dryer from our client.  If the lease was not terminated by Mr. Hopkins at the end of the 12 month period it would continue as a month-to-month lease.  The lease payments were $29 per month.  There was a contractual late fee of $15 per month.  Mr. Hopkins paid the four payments  ( 5/2020, 7/2020, 8/2020, 9/2020) and failed to make all subsequent payments.  November 2022 he vacated his apartment at The Springs apartments and failed to return the washer and dry and were charged $892.68 (the value of the washer/dryer) plus all the unpaid monthly payments and late fees of $1,144.00.

       

      The account was assigned to our office on 12/29/2022.  We sent our first notice to the El Paso address.  It was returned by the Post Office on 1/20/23.  He was relocated at his present address and the 1st notice was resent on 1/23/23.   On 2/13/23 a notice of intent to credit report the debt was mailed to Mr. Hopkins.  Our office tried to reach him by phone and was unable to do so. 

       

      At no time after receiving our notices did he dispute any of the charges.

      7/29/22 ******* ****** called the office and said he never lived at the residence. We confimied with
      the client that ******* was the tenant. 10/23/22 he called again and offered to pay in fiill if we removed
      it from his credit and he admitted he lived there. He was told we were willing to do that. He wanted to
      email us an agreement to that effect and we told him we would sign such a document. At no time did
      ask for a verification of the account, a first he was denying he was the tenant and then it changed to he
      wanted to pay. Unfortunately, he has not been truthful with his claims. He was offered the opportunity
      to call me. but he never did. I would have handled the file exactly how ****** did. She followed all
      lawful and company procedures.

       I am rejecting this response because:

      Information provided by the company is false, I called many times asking for verification. I also sent multiple emails for a pay to deleted letter. I asked for them to verify the debt which they never did as well. I wanted to pay for the debt because it’s affecting my ability to get a house and apply for certain jobs because it’s affecting my credit score due to it being marked as a collection not because it belonged to me. Staff was very rude and disrespectful thing company has many negative reviews and experiences by many people. I never admitted living in the residence or that the debt was mine.

      In order for any debt to be collected it must be verified

      In accordance with the Fair Credit Reporting Act Convergent Account #****** has violated my rights. ** ***** **** ******* *** *. States I have the right to privacy. 15 U.S.C 1681 Section 604 A Section 2: It also states a consumer reporting agency cannot furnish a account without my written instructions15 U.S.C 1681c. (a)(5) Section States: no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. 15 U.S.C. 1681s-2 (A)(1) A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate.

      Company is also providing false inform in the second statements, ****** has not paid or made any agreements with them. The reason I know this company is not acting properly or fairly is because ****** does not speak english nor has lived in this country for the past 10 months long before any letter was sent by the company.

      Three different notices were sent to Mr. **** and at the same address he shown on his complaint.  The first was mailed on 6/7/21.  That was our initial demand which noticed him on his right to dispute and/or seek validation of the debt.  A second notice was mailed on 7/19/21 and a third on 8/30/21.  All notices were mailed to the same address and none of them were returned by the post office.  Under the law, letters mailed to the correct address and not returned to the sender, are presumed to be delivered. 

       

      There has been no violation of the FDCPA or the FCRA.  Our office will send Mr. **** a validation of the debt.
