      Hello, The owner of a property hired granite to demo existing car wash station. Granite had a sub-contractor start work but one or two days once they started the City of ********** stopped them. The City had let the owner know that Granite did not submit for a permit and did not have proper safety. The owner had also paid in full the amount for the proposed work. The owner is a spanish speaking person and when she tried to get the balance for work not completed Granite did not help her and did not get back to her with any support. The owner wants to get the money back she is owned for work not performed. Granite had also tried to deny the owner payment for the reason that they had closed there year end accounting books. This is unethical and wrong for Granite to provide an excuse. The owner has supporting documents to show the balance she is owned.

      Dear ****** *******,

      Granite Construction Company ("Granite") hereby submits this response to BBB complaint ID 15808078 and denies the allegations contained in the complaint. Granite entered into a contract with ****** and ****** ****** ("Owner") on March 4,2019, to perform demolition work at a war wash located at *** El ****** in **********. The contract specified that Granite was not responsible for obtaining the permits; this was the *******' obligation. The value of the contract was $25,000. On October 9,2019, Granite mobilized to the site and started to perform demolition in accordance with the contract and in coordination with the *******.

      After Granite mobilized to the site and started work, the project was shut down due to the ******* failing to obtain the proper permits. Based on **********s. CA webiste, no permit has been approved for this address, but a demolition permit was submitted on August 3, 2021, for *** El ****** Real, in **********.

      Accordance with Article 7 of the contract, Granite requested payment for the labor and equipment provide to the site on October 9,2019, for services rendered in the amount of $10,950.65. Granite provided all backup documentation with its invoice. The invoice was paid in late 2019.

      Granite operated in good faith at all times when dealing with the *******. Notably, the contract was valid until June 2019, Granite could not honor it further due to price escalations. Granite proposed to come back in February 2020 to compete the same scope of work for $29,500, but the ******* did not accept Granite's proposal.

      Granite Construction Company has fulfilled its obligation under the contract on October 9th, 2019.   The special condition of our proposal addressed permitting, which was the owner responsibility.  In accordance with article 7 of the contract Granite requested payment for the labor and equipment provide to the site on October 9th caused by the delay.   We supplied an extra work bill with all the backup for $10,950.65.  Bill was paid in late 2019.   Our original contract was valid until June 2019, and while we honored it October, 2019, Granite would not honor it further.   Granite proposed to come back in February 2020 to compete the same scope for $29,500, but no work was performed.
