On January 11, 2023, BBB Serving Los Angeles and Silicon Valley requested that the business substantiate, modify, or discontinue claims on the company's website, https://chomperlabs.com. The business advertises:

- “Voted Best Customizable Night Guard by SleepFoundation®”

- “Night guards that are FDA-approved, BPA-free, and latex-free, so you can be chemical-free and grind-free.” 

- “They're not only FDA approved, but also CE certified according to European Union standards.” 

- “Our night guard materials are imported directly from Germany at 3 times the usual cost and are not only FDA approved but CE certified (according to European standards, which are higher than in the US).” 

BBB also requested clarification and substantiation for various organizations advertised on their website. Specifically, the business lists: SleepFoundation, BuzzFeed, Health, Medical News Today, and Sleep.org. 

The BBB Code of Advertising states that, "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.” 

The BBB Code of Advertising also states, "21.1 The composition and layout of advertisements should be such as to minimize the possibility of misunderstanding by the reader. 21.1.1 For example, prices, illustrations or descriptions must not be so placed or displayed in an advertisement as to give the impression that the price or terms of featured products or services apply to other products or services in the advertisement, when such is not the case.” 

The BBB Code of Advertising also states, “34. Claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data.” 

While the business initially responded to BBB, as of February 13, 2023, the business has failed to substantiate, modify, or discontinue the advertised claims brought to its attention.
