      We purchased a manufactured home from Statewide Homes on 6/27/22. It was built by Skyline Homes in ****** . It arrived on April 20, 2023. Statewide's contractor, GS Construction, put the two halves together on our foundation even though they knew it had water intrusion from a hole in the roof where ******* had failed to install one of the roof vents. *************************, owner of Statewide Homes, told us there was not a water problem; however, *************************, owner of GS Construction, said there was a water problem from the hole in the roof. A large portion of the ceiling had collapsed, the sheetrock seams have come apart and there is visible mold. We had a mold report completed by Signet Home Inspection. The results show toxic mold and many other forms of mold throughout the structure. Servpro inspected the home in June, 2023. The quote at that time was $60,000 to remediate the mold plus the cost of rebuilding. There is a moisture barrier under the home. GS Construction slit the moisture barrier to allow the thousands of gallons of water to drain. We have a video of the moisture barrier. We refused the home but Statewide will not return our purchase price or remove the home from our property. We had Cal Fire Deputy ********, ***********************, and ********************** Inspector, ***********************, inspect the home. *********************** wrote a report stating that the roof vents are not Cal Fire, WUI compliant.

      I will try to address each of the items in ****************** letter.  

      The $30,000 Statewide claims we owe is for transporting the home from ***********, ******, where it was manufactured and having their contractor, GS Construction set it up on our foundation.  *************************, owner of GS Construction, had his crew put the two halves together and seal it up knowing of the water intrusion.  *********************** claimed there was no water in the home and that a tree branch had penetrated the roof while in transit.  ************************* is the person who told us of the hole in the roof and said that a branch had not hit the roof as *********************** claimed.  His employee, **************, told us that the home had not been properly wrapped and had sat in the elements taking on water.

      Statewide Homes NEVER offered to fix the damage from the water intrusion.  Instead ***** and *********************** called us numerous times telling us to come to their office and pay them the money to complete escrow.  They would not allow a walk-through inspection nor would they allow us into the home.  They locked the home and it still remains locked.  The Yelp reviews of Statewide state once you give them the money, they do not respond.  

      *********************** claims they would have a mold inspection once the repairs were complete.  Again, they NEVER said this.  What they did say was come to our office and pay us the remainder of the money to complete the transaction.

      It is also not true about the mold report we had completed.  The testing was done throughout the home.  The mold inspector even tried to test under the home into the moisture barrier but there was so much water, he couldnt get into the moisture barrier.  He said it was like a waterfall.  As far as a couple of gallons of water, as *********************** claims, we have a video showing the vast amount of water.  The contractor, GS Construction, NEVER contacted us to come back and neither has Statewide.

      Skylines representative did contact me via telephone concerning replacing the non-WUI compliant roof vents.  He also stated they were WUI compliant.  I did not refuse him entry to our property but told him to contact our attorney.  He never did contact the attorney.

      Statewide, Skyline and GS Construction have made no attempts to correct the problems as *********************** claims.  She has only repeatedly ask for the additional money she claims we owe.  Since *********************** has lied throughout this entire process, we would never believe anything she says concerning this business.

      As for the completion of the foundation, after our building permit was issued, the ground was too wet from the very large wet storms to have the dirt work or the foundation poured.  ***********************, Statewide employee, is well aware of the delays in ascertaining our permit, as she was the one working with the building department to get the permit.  We have all of the emails from **************** to the building department.  *********************** is fully aware of these facts.  For her to allude to any other reason for the delay, is just another of her falsehoods.

      Statewide has also paid from the contingency $2800 storage fees for the time the ******** in ****** before being transported to our property.  ***********************, Statewide employee, quoted us $200 per month for the storage and said that Statewide would help with these fees.  Instead they are now charging $2800 storage for the four months.  Statewide also paid from the contingency $5250 for transportation.  When Statewide delivered the home to our property, they began to set the home backwards.  They had the front door facing to the rear.  When we saw what they were doing, we showed them the site plan.  They then set the home correctly but are now charging us the $5250 for their mistake.

      The complaint from *************** is filed with misinformation and several outright lies! One specific, and very important issue, is the timing of the completion of the foundation. Had they completed the foundation in a timely manner NONE of the water intrusion would have occurred as the missing vent would have been found during the setup of the house.  *************** claims "the ground was too wet from the very large wet storms" however their permit was issued on October 11th and I have attached the weather reports proving they had several weeks to get the foundation done. *************** is very aware that it is not possible to remove the house from its location.  The neighbors accommodated delivery before putting in a brand new fence and made it very clear that the only opportunity to bring a home into the property was the week before their new fence was installed.  To be clear, there is no possible access to remove this manufactured home and *************** is aware of this fact. 

      On a side note, in December of 2018, we were contacted by the Bacons to move forward with a project for a second home on their property for their adult son.  After working with them for a couple of months, they changed their minds and didn't pursue the project.  They returned in 2022 and proceeded with the home purchase.  Then after the home was built, they asked us about selling it before it even left the factory.  We told them no, they were unfortunately under contract.  It is clear that buyer's remorse is the real reason for this complaint.  

      Statewide homes, as well as Skyline Homes, have offered from the beginning and continue to offer to complete the manufactured home and make any and all repairs needed to help final their home even though the foundation was their responsibility.

      This is all that can possibly be offered.  ********** Housing and Development law, along with ********** contractor law requires the customer to allow repairs to be completed.  The Bacons have not allowed anyone on their property.  They simply want the house to go away. This is not possible.

      I am rejecting this response because:  

      I am writing in response to *********************** email dated 3/28/2024. I sent an email dated April 8, 2024, stating that I had not received ****************** response. I had written my complaint rebuttal on February 13, 2024, and on February 28, 2024, I received an email from your department stating as of that date you had not heard from the Murrays or Statewide Homes. I called and ask if the business had the same seven days to respond and I was told yes. Since many weeks had past, I was not looking for a response from Statewide Homes. Now, because I did not respond in the seven days, my compliant has been closed. Also, you stated I could contact my Dispute Resolution Specialist. I was never given a Dispute Resolution Specialist. I would very much like to have one assigned.

      I would like to respond to ****************** false allegations. Most importantly, we have the right to reject the goods under the **********
      Commercial Code. Despite that, Statewide Homes have refused to pick up the unit and refund us our money. We contracted for a brand-new unit, not one that was substantially damaged and structurally compromised from the factory. The unit arrived with extensive water damage from the factory. *********************** and Statewide Homes have tried to imply that it was damaged due to our fault. That is a complete fabrication. The unit arrived with extensive water damage because Champion Homes (Skyline Homes) left out a vent in the roof. Also one of GS ********************* **************, told us that the home had not been wrapped correctly and it sat in the elements taking on water. It has mold and you have a copy of the mold report that was an attachment to my email dated February 13, 2024.

      I will now address all of the falsehoods in ****************** email:

      He claims we did not get the foundation done in time. Our contractor stated that the ground was too wet to proceed with the ground work and to then pour the foundation. He is ready to state this fact. *********************** also claims that the manufactured home cannot be removed from our property because our neighbor had a new fence built. Our neighbor and her fence contractor have both stated that the fence can come down and be rebuilt. (*********************** and Statewide Homes are well aware of all of these facts.)

      *********************** also claims that in December 2018 we told Statewide to move forward with a home for our son. Another falsehood. We stopped in to speak with them to gather information about manufactured homes as we also stopped in to visit with the manufactured home dealer in Auburn and another on Highway 49 but we certainly did not spend months talking with them about the project.

      We did not contact them about selling the home before it left the factory. And, we did not have buyers remorse. We were very excited to receive the home and for our son to have his own home. We had customed several things in the home and were very excited.

      They have only offered to repair the home AFTER we pay the additional money they say we owe. (And, I might add that several of the charges they say we owe are trumped up.). We have refused the home.
