      This company damaged my vehicle. Their workers did not cone off the street where they were working and left debris in the road which I drove through. I sustained damage to my car and the supervisor will not provide their insurance info so I can file a claim which is a crime.

      I live in************* in************* and Bennett Landscape Co. is contracted to landscape the common areas of the community only, and not the plants that are planted on any homeowner's personal property. The Bennett Landscape workers have cut branches off my tree which is planted in my personal courtyard, behind a wrought iron gate and two walls approx, 5 ft tall. When I asked them about it, they said the branches were bothering them when they worked as the branches hung over my gate and walls. I told them they had no right to do that and if they would have contacted me, we could have come to an agreement that would have satisfied both parties. They shrugged and laughed, then walked away. They have called me crazy lady at different times, have taunted me, and been very rude. At no time did Bennett Landscape Co. or any representative ask me for permission to cut my tree and they have never been authorized to do so by anyone. They have ruined my tree, it has grown very tall with no low branches, and offers no shade. Bird nests have been ruined; chimes, and a birdhouse were knocked down and left on the ground. The latest time they cut branches was in September 2021. I complained to the HOA and they sent my letters to Bennett. In late Dec 2021 - early Jan 2022, I complained directly to Bennett on their website and asked them to get in touch with me by January 31, 2022 so we could discuss the damage to my personal property. NO ONE AT BENNETT LANDSCAPE HAS RESPONDED TO MY COMPLAINT. NO ONE HAS EVER CALLED ME TO INQUIRE ABOUT MY TREE, OR APOLOGIZE FOR THE DAMAGE THEIR WORKERS HAVE DONE TO MY TREE, OR REGARDING THEIR WORKERS' BEHAVIOR TOWARD ME.

      Business Response /* (1000, 5, 2022/02/16) */ Please see attachment and supporting documents for complete details. Bennett Landscape has completed a full investigation into this matter, including an onsite visit, and several discussions with property management representatives. As a result of this investigation, it has been determined that there is no basis for this claim due to the following reasons: 1. There are no fresh cuts or damage to the tree in question (please see attached images of tree); and 2. Company policy does not permit team members to enter property's resident interior areas or allow crew to perform duties outside scope of work; and 3. On December 3, 2021 was advised by **************************** representative "no additional attention was needed in this matter". Standard company protocol dictates residents communicate through property management, ******** ******** Management, after which management relays resident communication to Bennett Landscape. Communication between ******** ********** and Bennett Landscape had been ongoing as shown in timeline (attached). Bennett Landscape respectfully requests this complaint be dismissed without prejudice due to frivolous and damaging claims made by resident. Consumer Response /* (3000, 7, 2022/02/28) */ (The consumer indicated he/she DID NOT accept the response from the business.) This is not a frivolous claim and if it is damaging, it is only because I have brought to light the irresponsible and dishonest business practices of ******* Landscape Co.; namely, they are damaging themselves. DISHONEST BEHAVIOR #1: (11/29/21 timeline entry) A. No "fresh cuts" to tree. My Response: The photos *** ******* submitted to BBB were not of the fresh cuts made directly on the branches which hang out and over my gate/interior property and onto the common entryway as I stated in my complaint; one of the photos he submitted is a full photo of my tree with no close up of the branches showing cut marks, and the other is the trunk of my tree, which does not hang over my gate onto the common area entryway. Further, a HOA Board member lives across the street from me and I showed him the fresh cuts on the branches of my tree. He told me I was within my rights to complain. He also stated that other homeowners were dissatisfied with ******* workers and some had also complained about their rude behavior, which I also experienced when I tried talking to the workers and asked them why they were damaging my tree. INTENT TO CONFUSE #1: (11/29/21 timeline entry) B. Company policy does not allow team members to go enter resident interior area. My Response: There would have been no need for the ******* crew to have gone inside my property to see the fresh cuts because as stated above and in my complaint, the fresh cuts were on the branches which reach out of my property and hang over the common area, which is where the ******* workers cut the branches to begin with, without my knowledge or my authorization to do so. INTENT TO CONFUSE #2: (11/29/21 timeline entry) C. Standard practice for all team members which do not allow for crew to perform duties outside scope of work. My Response: What is *** ******* talking about? I never asked for, nor did I state in my complaint, that I expected any ******* worker to perform duties outside scope of their work. He is trying to create confusion to my complaint. DISHONEST BEHAVIOR #2: (12/3/21 timeline entry). *** ******* claims a ******** ******** Mgmnt. Co. representative told him "no additional attention was needed in this matter". This is not true. I contacted *** ************** directly, whom *** ******* names in his timeline, and ********* denies ever having said that (please see attachment #1: ************ response to *** ********* dishonest statement). DISHONEST BEHAVIOR #3: (12/3/21 timeline entry). *** ******* claims he extended an offer to meet with me. As can be seen from ************ email to me (attachment #1) *** ****** also denies that *** ******* extended an offer to meet with me, as *** ******* claims he did. DUBIOUS INTENT: On 2/24/22, I received an email from *** ******* asking me to meet with him in late March 2022. (attachment #2) This would have been outside the time period I was to answer the ******* response with BBB. (I was given 10 days to respond.) Further, I work full time in *********** and am gone from my home between 6:00AM-5:00PM. Additionally, I question why *** ******* wants to meet with me after calling my claim "frivolous"? IRRESPONSIBLE BEHAVIOR: If *** ******* was an ethical and responsible businessman, his behavior would have been different from the moment he was informed of my complaint of close to 3 months ago: 1) He would have taken photos of the fresh cuts on the branches of my tree instead of the whole tree and the trunk of the tree. 2) He would not have made an attempt to confuse by stating unrelated issues on his timeline. 3) He would have asked for a meeting with myself and the property management company 3 months ago and cc'd me on that request. 4) He could have contacted me directly or met with me as I PROPOSED IN JANUARY 2022; he had my contact information, and even acknowledges this on the 01/13/22 entry on his timeline,. 5) He would have not lied and stated *** ******, a representative of ***************** Management Co., had told him "no additional attention was needed in this matter", as stated on 12/3/21 entry on ******* timeline; and that an offer to meet with me and a representative from ******** Management Co. had been extended to me when it was not. Additionally, in the 01/18/22 entry of his timeline, *** ******* states that "standard protocol is that residents go through management company after which management communicates Resident concern with ******* Landscape. Requested Julie communicate our position with regards to Complaint directly with HOA resident***. ***." My Response: What exactly is *** ********* point? We did exactly that and he knows it because copies of my complaint were sent to him in November 2021, and he was provided with the fact that I would/could meet with him in January 2022, before the 18th, as I would be returning to work that day. I can provide copies of the emails that prove that this process was followed if needed.
