      We contracted with **** Roofing to have our roof replaced and new skylights installed. Contract was executed around May, 2022, with agreement work would commence 08/2022 and take approximately 3 weeks.Roof replacement was completed first week of September. I, the homeowner, found countless old nails left behind from the demolition of the original roof. It took ***** of **** roofing 3 weeks to visit the site and confirm nails were, indeed left behind. No resolution was achieved.Skylights were not installed until 10/28/2022. Well after the 3 week construction time agreed upon by the I, the homeowner and **** Roofing. Multiple calls to **** roofing were met with extreme disdain from the receptionist, *****************, who falsely identifies herself as a CFO. There is no ***************** listed in the Secretary of State listing (found here: https://www.sos.******/business-programs/bizfile/search-online), making her claim as a CFO as stated in her email signature false. This is one of many examples of **** Roofing misrepresenting itself to myself and several other customers.

      Contract was executed around May, 2022, with agreement work would commence 08/2022 and take approximately three weeks.

      We received your signed proposal on June 16th, 2022, and work did commence the end of August 2022.  You and your wife were previously informed that the re-roofing work itself (minus the skylights) would take approximately five days to complete (give or take) and that after taking additional measurements for the skylights which could only be done once the old roof was torn off that the manufacture of the skylights would take approximately three weeks once they were released for production with the skylight manufacturer.  The timeline for the skylight manufacture was reiterated in an email sent to you and *********** (your solar contractor; we were unaware you were contracted with them until after we had torn off the old roof) regarding the scheduling of the final inspection with the County.  The manufacture of the skylights was completed within that three-week timeline (released for production on 08/30/2022 and were completed for manufacture on 09/26/2022).  When we didnt come and install the skylights the moment they were finished being manufactured, you sent us an email threatening to cancel the skylight replacement work and have someone else do it if we didnt do it by the Monday after you sent your email.  We then had to remind you that per the proposal contract terms, you would be responsible for the costs of the skylights if you cancelled the work.  We also made it clear that we were at the mercy of the skylight manufacturer as to when they would be able to deliver the skylights to us and that you were welcome to contact them with your grievances.  Bottom line:  We never told you that the project would take approximately three weeks to complete.

      I, the homeowner, found countless old nails left behind from the demolition of the original roof.  It took ***** of **** roofing 3 weeks to visit the site and confirm nails were, left behind.  No resolution achieved.

      When we were first informed of the nails, your wife made it sound like it was just a minor problem, but that otherwise everything was good.  It was after that you began sending us angry emails stating that you had found countless nails on your property and threatened to have someone else come and clean them up and send us a bill for the cost.  Our secretary ********* then reached out to our roof removal subcontractor who then requested for pictures of the nails from the homeowner (you) so that they could use them to help their workmen improve their practices and clean up whatever nails were there.  After she (*********) emailed you and your wife on 09/07/2022 asking for pictures of the nails per the subcontractors request with no response from either of you, we invoiced you for the re-roofing work.  Shortly after, your wife began sending us similar emails regarding the nails, including one in particular where she claimed it would take 2.5 hours to clean up the nails and charge us $195.00 an hour to do it.  You also sent us at least one email claiming you would back charge us each day that the issue remained unresolved.  I should note that you also finally emailed pictures of the nails ten days after ********** request.  Those pictures were questionable as they did not contain the countless nails you claimed were left behind on your property.  After several unreturned phone calls from ******************* to resolve the issue, he sent some emails requesting that we be allowed the opportunity to see the nails and then clean them up.  Your wife then agreed to allow ***** to come and see the nails and clean them up.  Due to previous scheduling obligations, the earliest he could go out there was on 09/26/2022, in which he not only saw the ***** nails, but cleaned them up and removed them from your property.  The issue was thereby resolved.

      Skylights were not installed until 10/28/2022.  Well after the 3-week construction timeline agreed upon by I, the homeowner, and **** Roofing.

      Again,per the first paragraph of this response, we did not ever tell you that the project would take three weeks to complete.  It was also out of our control as to when our skylight manufacturer would be able to deliver them to us.

      I,*****************, have never spoken over the phone with you that I can recall.  In fact, it was shortly after we began working on your roof that you began treating us with disdain and even got so angry with ******************* that you ceased to speak to him and had your wife take over as the point of contact.  Our secretary ********* spoke with you when you initially contacted us for an estimate for re-roofing your home.  She has also spoken with your wife with regards to scheduling and payments.  I wrote you one email, dated 10/06/2022 regarding the status of the skylights.  Your statement about me falsely identifying myself as CFO is incorrect.  If you had downloaded our Statement of Information from our business file on the Secretary of States web site, you would have seen me, ************* ****, listed as *************** ******** **************** Our secretary ********* is our one hired clerical employee.  Bottom line:  We never misrepresented ourselves to you.

      I am rejecting this response because:

      • No mention of the time frame of three weeks to complete the job was addressed. 
      • I still maintain it took well over 3 months to complete what should have been a 3 week project. 
      • Furthermore, **** Roofing requested we wait to install our solar system until after skylights were installed, 
        • which would have resulted in major delays to the rest of the project. Said request was denied
      • Also, the issue of nails and other roofing debris left behind was not addressed. 
        • I am still finding nails in my yard 4 months after roof demolition.

      Attached please find copies of email correspondences between ** and ********************* and his wife ******************************************  Also please find attached a copy of the page of their signed proposal contract where we stated that it would be about **** weeks before we could begin the re-roofing work once we received their signed proposal and that all agreements are contingent on delays beyond our control.

      **************** has been impossible to please since the day we began tearing off his and ****************************** old roof.

      **************** in his latest response states that, "No mention of the time frame of three weeks to complete the job was addressed."  That statement is false as the first paragraph in our response to the complaint stated the following:

      Regarding his latest statement about the project taking well over three months to complete:  We received. their signed proposal contract on June 13th, 2022.  We started the re-roofing work on 08/24/2022 and completed the installation of the new roof on 08/29/2022.  We passed the final inspection with the County of Alameda on 09/01/2022.  His skylights were released for production on 08/30/2022 and were finished being manufactured on 09/26/2022.  Due to logistical reasons, the skylight manufacturer was unable to deliver the skylights until 10/17/2022.  Skylights weren't installed until 10/28/2022 because **************** and ************************** were out of town the week of 10/17/22-10/21/22.  While yes, it would have been more ideal to replace the skylights prior to the installation of the solar panels, it was not impossible as we were able to replace their skylights long after their solar panels were installed.

      Lastly, his statement about the issue of the nails and other roofing debris left behind not being addressed is false as the second paragraph in our first response to the complaint was as follows:

      Between clean up done by our tear-off subcontractor and ******************* picking up the ***** nails he found on 09/26/2022, **************** and ************************** should not be continuing to encounter nails on their property a little more than two months after we tore off their old roof and installed the new one.

      I am rejecting this response because:

       

      The tone of this response is just another clear example of **** Roofing being unwilling to take responsibility of their subpar performance and further attacking the client, who promptly paid all invoices when requested. It is indeed true I, *********************, refused to further speak with **** roofing due to their completely inappropriate and disrespectful tone towards a client. **** seems to be unwilling or unable to grasp the concept of "the customer is always right" and instead they choose to dig their heels in and not be empathetic towards anyone's needs but their own, hence their request to delay solar installation based on what they are terming as a delay by their skylight manufacturer. It should be noted that there was NEVER a discussion about delays by the skylight contractor until we became fed up with the ongoing delays and had to switch from a complacent tone to a more aggressive tone in order to get answers. **** never in good faith communicated this delay until specifically asked about it. It should be considered due diligence to inform the client of ANY & ALL delays due to manufacturing in a timely manner.

      Were sorry **************** remains dissatisfied with our job performance as well as our responses to his complaints.  Over the past sixty-five years in the roofing industry, we have strived to provide the best possible workmanship, professionalism, and customer service, as seen by our high ratings over the years.  We have answered all emails and phone calls with respect to our customers and never with disdain.  We have also made a reputation of being an honest company, and we take accusations of negligence and falsehoods quite seriously.  We believe that in previous emails to you, we have documented with our emails back and forth with **************** and ************************** that we have attempted numerous times to satisfy their complaints.
       
      As stated previously, **************** has been most difficult to please since the day we tore the old roof off his and ****************************** home.  Per the contract they signed, we installed a new roof and skylights on their home in accordance with current building codes and industry standards and included our numerous attempts to keep them informed of the progress of the job.  The roof was inspected by Alameda County building inspectors and according to their final inspection, work was also done according to their standards.  The invoice for the re-roofing work was mailed and emailed to **************** and ************************** on 09/14/2022.  Their first payment to us was on 09/27/2022 and the second payment was on 09/30/2022.  The skylight invoice was mailed and emailed to **************** and ************************** on 11/02/2022 and to date remains unpaid.
       
      It appears that no matter how hard we have tried to accommodate and appease **************** and ************************** as indicated in our letter to you as well as the attached documentation, nothing has appeared to appease their complaints.  There is nothing further that we can provide or do which would resolve this situation to their satisfaction.  We have done all that we can possibly do.
