I have a small business and had a business account with the Bank of Hemet since 2015. They charge $34 for every overdraft transaction. Over the years I have seen things that let me doubt their integrity. 1. If an account is in overdraft in the morning, but money is coming in in the afternoon, they still charge overdraft fees. 2. If money is deposited on Friday after work hours they still charge overdraft fees on Monday. 3. Sometimes I had seen the money coming in the same day but when I looked the next day, it was booked as coming in a day later and overdraft fees were charged. I have paid $1,676 in overdraft fees so far in 2021. $1,531 in 2020, over $1,200 in 2019, over $1,700 in 2018, and about $800 in 2017. This amounts to about $7000 total!!! I had to close my business this year due to the Covid policies and not qualifying for the PPP2 loans due to legal language. Who can afford to pay almost $1700 in overdraft fees with a closed business and on unemployment?Business response

We have reviewed the complaint and discovered the following regarding this situation.
Checks are presented for payment each night and are looking to the balance in the account at the end of that business day.
Deposits are posted to the account when received, unless after business hours then the deposit will post the following business day. Deposits post to the account first so that checks coming in for payment that night can be paid against the deposited funds if available. In this customers case many of his deposit are received through ACH (electronic deposit) and are made available in accordance with *** *, on the settlement date as stated in the ACH file.
Although we have spoken to him on numerous occasions on how to avoid NSF fees, they continued. We have waived a considerable amount of NSF fees for him.
