We hired this business to install laminate and tile. In the beginning the owner told me he wanted half of the money for the job. And then he told me that we have to pay him 500 a day for the remaining balance in till it’s all paid in full. He changed me for the job 5,900 and I paid him 4,900. They didn’t do I good job, he hired guys with no experience at all. I called him after I found out all the mistakes and showed him everything, I told him take all the flooring back and give me my money back He walked away. He didn’t finish the jobs, he took my money and he didn’t finish the job and he didn’t repair anything. We just want our money back because all these guys don’t have any clue how to do laminate or tile.

Customer ***** ******* signed a contract for laminate and tile work that he requested. After the laminate and tile were installed, he complained about small gaps on the laminate. Since our work is guaranteed,  I told him that we will fix it and he was in agreement. The next day, we showed up to do small repairs and he asked us to take the laminate and tile back. How can we take it back when everything was already installed and the work was finished? He kicked the workers out. A few days later, we received an email indicating that the customer disputed the transaction as fraudulent. The customer provided the credit card at the shop when he signed for the job and he was video recorded doing it. His bank returned the money to him after he disputed. A copy of the email in which the money was returned to him for his dispute is attached.

Let me know if you have any further questions.

      Thank you!

      Subject: EMV fraud $2,900.00 dispute

      SQUARE SECURE

      Hello Gulf Star LLC,

A cardholder has disputed a payment you processed on November 29, 2021. They’ve filed a claim with their bank and their bank has notified us that this is an EMV payment dispute, which means this payment was processed in a way that isn’t compliant with credit card companies’ security guidelines (swiping a chip card when it should have been dipped into a chip reader).

      Dispute Reason:
      EMV liability shift

      Dispute Amount:
      $2,900.00

      See the receipt >

      Here's what happens next:

      You:
Your linked bank account will be immediately debited for the amount of $2,900.00 if these funds are not available in your Square balance.

If you believe this dispute was filed in error, we encourage you to reach out to the cardholder directly to collect a new payment. You can learn more about the disputed payment via your Dashboard.

      Square:
The banks don't give us any rights to challenge this claim because it didn't comply with their guidelines. Unfortunately, federal privacy regulations also prevent us from giving you the cardholder’s contact info.

You can avoid EMV disputes by processing chip-enabled cards with the Square Contactless and Chip Reader. Processing chip cards correctly will also provide you with an extra layer of security against fraud. Check out our page on the EMV Liability Shift.

      The Bank:
To minimize fraud, bank regulations transfer liability to merchants that swipe chip cards when they should have been inserted into a chip reader. These regulations apply to all card processors.

To learn about best practices on accepting card payments, see our Support Center article for more information.

      Sincerely,
      The Square Dispute Resolutions Team
