Dear Better Business Bureau, I am writing to file a formal complaint against Babytree Surrogacy, an agency specializing in surrogacy services. My experience with BabyTree has been highly disappointing and has led to significant frustration and financial loss. I seek your assistance in addressing this matter and obtaining a resolution. On December 20, 2022, my husband and I entered into a Retainer Agreement with BabyTree with the intention of collaborating with a selected surrogate named ***** *. As part of this agreement, we deposited $9989 into a trust fund account (see attachment1 and attachment2). However, just few days later, on December 30, BabyTree re-matched the same surrogate with another client, effectively voiding the initial agreement. This action is in direct contradiction to BabyTree's stated policy of initiating retainer payments only upon successful surrogate matching. It is evident that BabyTree falsely presented a surrogate match and subsequently reassigned the selected surrogate to someone else. Of further concern is BabyTree's insistence on retaining my deposit funds for ***** * within my trust account, despite the termination of the Gestational Surrogacy Contract and the lack of any surrogate being matched to me. This situation directly contradicts the terms outlined in the Fund Administration Agreement, which clearly states that the agreement shall automatically terminate three months after the termination of the Gestational Surrogacy Contract. Additionally, the agreement explicitly states that any remaining funds in the trust account should be promptly refunded to the Intended Parents within five (5) business days of written notification of such termination. It is essential to highlight that I have not availed any fee-based services from BabyTree. The recommendations of surrogates and interviews were provided as part of their marketing efforts and were presented to me free of charge. Despite this, BabyTree is refusing to release the funds held in the trust account for ***** *. Given these circumstances, I am seeking the BBB's intervention to ensure that BabyTree adheres to the terms outlined in their agreements and promptly refunds the remaining funds within my trust account. I kindly request your assistance in resolving this matter and ensuring that BabyTree operates transparently and ethically. Thank you for your attention to this matter.
