      I purchased a vehicle( Toyota camry2007). From this company. I purchased for my son, who is homeless, so he could get a job. I rode in the car the day I purchased it, I didn’t hear and unusual noises with the car. The owner insisted the car was in excellent mechanical repair. The car had approx. 115000 miles, which is not a lot for this type of vehicle. The following day when I was with my son I heard a funny noise coming from the car, I thought it could be a wheel bearing. My son continued to drive the car, and complained that it uses a lot of oil. I was not able to take the car for repair until last week. We were told that the car needs a new motor, and that there are metal shavings in the oil. There is also oil in the transmission. I did call the owner, but he insisted he did not sale me a bad car. He insisted his mechanic went through the car. I have a car fax for the car, but I question if it is real. Also I paid 4,000 on my credit card and 3,000 cash. I don’t think this company is legitimate. I would like the vehicle either fixed or half of my money back so it can be fixed. Please help!       Greetings Ms. ********,

       

      Thank you for providing me with the complaint from Ms. ******* concerning her purchase of the 2007 Toyota Camry from R.C. Auto Group.  I am both shocked and saddened by her decision to reach out to the Better Business Bureau instead of properly trying to resolve this matter civilly through our company channel. As such, I want to provide both a brief history of the transaction, as well as the one and only conversation I had about this vehicle related to her alleged “defects” as she refers to them. 

       

      Ms. ******* purchased the vehicle from R.C. Auto Group on October 29, 2021.  During that transaction, the following documentation was provided, reviewed, signed and agreed upon by Ms. ******* on October 29,2021 (and are also attached to this response):

       

      ·      83 Point Inspection Sheet by R.C. Auto Group (Conducted by a licensed third-party mechanical shop), including all issues that were identified, diagnosed and repaired.

      ·      Smog Check Inspection Clearance (Conducted on 7/29/2021)

      ·      National Motor Vehicle Title Information System (Run on 10/29/2021)

      ·      Ms. ********* signature and agreement to not purchase the Contract Cancellation Option (signed 10/29/2021)

      ·      Pre-Contract Disclosure: California (Retail Installment Sale Contract), signed on 10/29/2021, showing further refusal by Ms. ******* to purchase any 3rd party Warranty for the vehicle on 10/29/2021

      ·      Buyers Guide, signed by Ms. *******, showing the vehicle was sold “As-Is No Dealer Warranty” on 10/29/2021

      ·      Summary of Due Bill, with key notes stating the following: “No Work Promised”, “Vehicle is SOLD “AS-IS” condition with no guarantee or warranties either expressed or implied, for the vehicle.” “Any work promised must be completed within 30 days of  contract date.”

       

      R.C. Auto Group prides itself on being a legitimate, licensed, and bonded used car dealership.  RC Auto  Group makes every effort to be thorough in preparing all vehicles to ensure they are safe and reliable vehicles before they are placed for sale.  This same effort was also applied to the vehicle purchased by Ms. *******.  I would also like to add that Ms. ******* states in her complaint that she reached out to me, after she took her vehicle in for repairs, which means that she never contacted RC Auto Group on any issues related to the vehicle within the 90-day period that elapsed, following the purchase of her vehicle.  According to my records, the only time she reached out to me with concerns on her vehicle was on February 7th, at 12:10pm with the accusation that I sold her a bad vehicle.  I responded to her with an offer to  bring the vehicle in for an inspection by my mechanic  for a second opinion.  She refused and ended the call abruptly.  Finally, I would like to state and point out that Ms. ******* points out in her complaint that this “issue” with the vehicle was apparent shortly after the vehicle was purchased; however, she failed to notify us not even once in the 3- month period (90 days) from the time the vehicle was purchased. I can only question her lack of communication with our company until now as suspicious and deceiving. I would also take into consideration the manner her son was possibly mis-utilizing nor properly maintaining the vehicle between the time of purchase and her notification of her issue THREE (3) months later, which RC Auto should not be held responsible for after such a long period of silence from Ms. *******. 

       

      It is R.C. Auto Group’s stance that every effort was provided to be ethical and transparent to the customer during the time of purchase.  Furthermore, by self-admission from Ms. ******* in her complaint to your organization, she failed to communicate any issues with the vehicle until February 7th, 2022; hence there is no further liability by R.C. Auto Group to address this issue at hand.  Please let me know if you need any further documentation on this matter.
