  On 4/29/22 I contacted my daughters dental office via phone to get some answers to some questions I had about my daughter getting phase 1 braces at her office. When I was on the phone with Dr. ****** on 4/29/22 she stated ******* has underbite and stated "Have you not looked at your daughter recently, it's severe." Upon continuing the conversation, she said the treatment plan she is recommending is not cosmetic it is medically necessary due to her crossbite. Not knowing much about dental terms, I was confused since she had previously referred to it as an underbite. I asked which she had an underbite or crossbite and Dr. ****** reiterated it was severe but wouldn't confirm which or if they are even different. I asked her for the measurement of the underbite/crossbite and she replied stating "you do not need to know that and I will not be giving you that information, it's not important." On 5/3/22, I contacted Dr. Reimers Dental Group and spoke with Gavin. I requested from ***** a copy of my daughter's medical file, and explained I had also requested on 4/29/22. ***** transferred me to Dr. ******. Dr. ****** stated the following during our phone conversation on 5/3/22: She will NOT be providing me with a copy of my daughter's file prior to her records(x-rays/prep for braces) being taken and that she will be doing the records (x-rays/prep for braces) and will ONLY provide me copies of the x-rays, not the complete dental file. She stated I do not need and will not being providing me with all of the files from my daugherts regular dental. She stated withholding the file from me was in the best interest of my daughter and didn’t care that I had legal rights becauseI have not been the one who has been taking her to her appointments. I reiterated to her that I also have legal custody of my daughter and in accordance to HIPPA I am entitled to the entirety of her medical files.

  This is the first that this email got to my attention, I asked my receptionist to check if she had received it before and it looks like she had it, but with some link that she did not have access to. This is the first that we received it in this format. 
  

  
  

          There are so many statements in this letter that are wrong and were never said, that I would need to reply to each phrase, but here are some:

  
  

  He never asked me what was the difference between an anterior crossbite and an underbite, I would have explained it was the same. He did ask for the measurements of the crossbite and I said I didn't have the ortho records yet so I could not tell him how many millimeters it was.

  
  

          I never said anything like it would be in the best interest of his daughter to withhold any information from him, I said ortho treatment was in his daughters best interest and that the case would be sent to a orthodontist and he could communicate with the orthodontist to request anything else he needed. I did say he was making this more difficult for his daughter, that he never ever requested anything from us for the past few years until I mentioned the need for braces, he then hung up the phone on me.
  

  
  

          After all of that, mom did verbally authorized me to send files to dad. We sent all doctors notes, and imaging records. However the initial registration forms I was not able to send via email, and he still was not happy. I then told him that he could request anything else thru the mother who is the one that I have as legal parent on my files. 
  

  
  

           I only have mom's signature on all the papers and the stepdad as the financial responsible party. I did say he could ask mom for all the papers, the legal custody is between mom and dad.

  Again I only have mother as responsible party on my records and stepdad as financial responsible party. Any files that that dad still wants can be requested through mom and she can send them to him. This is my final response. - Sincerely Dr.******

   I am rejecting this response because:
  
  I still have not received copies of the medical file for my daughter in which I share legal custody of with her mother. Dr. ******'s Dental Group continues to deny me access to my daughters records. 

  
  

  The way I treated by Dr. ****** due to my daughter's mother failing to put my information on our daughter's medical information is unacceptable, as she knows and has acknowledged I share legal custody with the mom. 

  
  

  I still request the complete unaltered file for my daughter in accordance to HIPAA, and for Dr. ******'s Dental Group to no longer deny me access to the information I am legally entitled to. As stated previously, I am willing to pay the fee required for the file if required.
