I contacted LA Guitar Sales to buy a guitar... We agreed that I would send them **** usd to reserve the guitar. There was no other talk than this. After having received the **** usd deposit, they send me layaway conditions. They said that they decided to do a layaway, for which I would have 90 days to pay the guitar, or I would loose 1/3 of the value of the guitar, and the rest of the money was going to go in a store credit. We did NOT spoke about these terms before I sent them the **** usd desposit. The email was clear: I could not retract from the layaway, discuss the layaway conditions, and the layaway was going to start as soon as I received the email. I got a bad feeling about the honnesty of these people. I managed to buy the guitar, to have something to deal with them... The guitar is now at another store, waiting to know what to do. I am asking for a refund.Business response

Business Response /* (1000, 5, 2021/12/06) */ This transaction started January of 2021. The customer, who lives in Switzerland was interested in one of our pre owned guitars. After negotiating a deal including shipping she sent us a deposit instead of the full payment that was promised telling us she will have more money "soon". We informed her that we can set up the sale as a layaway or cancel and we emailed her out layaway terms which can be found on our website. She agreed to the layaway terms but went five months beyond what was agreed. Once we finally received full payment she instructed us to ship the guitar to a US dealer where she was planning to trade the guitar in for something else. We shipped the guitar and confirmed with that store that they got it. Weeks after the guitar arrived at the other store the customer reached out to us asking if she could trade back the guitar or get a refund. We informed her that we fulfilled our obligation, had no intention in starting a new transaction with her and considered this matter closed. This seller is not telling the truth: I have the emails to confirm. - I did not promised a full payment for the guitar ( he says I promised a full payment ) - We agreed on reserving the guitar with a **** deposit - There was no other talk than that - After he received the **** usd payment, he sent me layways conditions - we did not agree on any layaway conditions before sending the **** usd - The seller said I could cancel the layaway: It's false, he forced me into the layaway. He had my **** usd, I had no choice. This layaway was new, forced to me, ugly - The layaway was clear: I could not retract from it, I could not discuss the terms, and I would loose **** usd, the rest of the money would go in store credit, if failing to have the total in the layaway terms - I was forced into buying the guitar - I took the time to try to resolve this situation before reaching for BBB, that is why he is receiving the complaint now. Business Response /* (4000, 9, 2021/12/14) */ We have all the documentation, including her original offer and when she sent less than full payment, her agreeing to our layaway terms which are also clearly outlined on our site. As noted already, after receiving the final payment eight months after the original payment, per the clients orders we shipped the guitar to another US dealer. We were told she was going to trade it for another guitar they had in stock. We have proof of this as well by way of her emails and this other US dealer confirmed delivery on her behalf. We have proof of this as well. We no longer have the guitar so at this point this client needs to complete what ever deal they had with the other US dealer who now has her guitar. Again: - We agreed on a **** usd deposit - After he received the **** usd, the seller sent me new layaway conditions - I had to accept the layaway - Failing to the layaway, I would loose **** usd, the rest in store credit. x Business Response /* (4000, 13, 2021/12/22) */ This is getting nowhere. Bottom line, she took eight months to pay for the guitar and once it was paid in full she asked us to ship the guitar to another store in the US so she can do a trade deal with them. We have fulfilled our obligation in this matter and our business with this customer has been completed. Business Response /* (4000, 22, 2022/01/06) */ Once again and hopefully for the last time. After eight months the guitar was finally paid for in full and per the customers instructions we shipped her guitar to another dealer in the US where she had plans to trade the guitar in. That dealer confirmed possession of her guitar which fulfilled our obligation. We have gone above and beyond here as we do with all our customers. Thank you Consumer Response /* (4200, 29, 2022/01/21) */ sorry, I answered recently... My answer failed to uplaod maybe? Here it is- Once again: - We agreed on a **** deposit to reserve the guitar - I sent them **** usd - After they received the **** usd, they sent me new layaway conditions - I had to accept the new layaway - Failing to the new layaway, I would loose **** usd, the rest of the money in store credit Business Response /* (4000, 31, 2022/01/28) */ Once again, after taking eight months to pay for the guitar she asked us to ship her guitar to another US dealer where she was planning to trade the guitar in. Guitar has been shipped to that dealer and that dealer has confirmed receipt. Consumer Response /* (4200, 33, 2022/02/06) */ (The consumer indicated he/she DID NOT accept the response from the business.) In short, they changed buying agrements after receiving a **** usd despost. I would loose **** usd, the rest in store credits, failing to the new agrement. I could not refuse the new agrement.
