November 3, 2021 The following describes a consent order that has been formally brought by a government agency. The State of Minnesota Department of Commerce alleges and charges as follows:
Commissioner of Commerce Grace Arnold (Commissioner) has determined as follows:
Respondent sold bullion products to Minnesota consumers in an amount exceeding statutory thresholds without having renewed its registration with the Department of Commerce in violation of Minnesota Statutes. Respondents' bullion product representatives who sold bullion products to Minnesota consumers were not registered with the Department of Commerce in violation of Minnesota Statues. During the times of license and non-renewal periods Respondent's surety bond coverage was insufficient for the volume of Minnesota consumer transactions, in violation of Minnesota Statues.
Respondent acknowledges that it has been advised of its rights to a hearing in this matter, to present argument to the Commissioner, and to appeal from any adverse determination after a hearing. Respondent hereby expressly waives those rights. Respondent further acknowledges that it has been represented by legal counsel throughout these proceedings or has waived that right.
NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Minn. Stat. Ch. 45 (2020) that:
A. Respondent shall pay a civil penalty in the amount of $2,500 to the State of Minnesota at the time the Consent to Entry of Order is signed;
B. Respondent shall cease and desist from violating any laws, rules, or orders related to the duties and responsibilities entrusted to the Commissioner under Minnesota Statute Chapters 45 and BOG; and
C. In a separate payment to the Department, Respondent shall pay investigative costs in the amount of $225 pursuant to Minn. Stat. § 45.027, subd. 1(8) (2020) at the time the Consent to Entry is signed.
