      7/15/2023 Bohner L******** Marine has withheld money owed to me. Dealer is unwilling to pay even though I have proof money is owed. The owner is being deceptive and misleading. Will file lawsuit if dealer does not make right

      B****** *** claims to have sold a boat to Vern and Lori Castro. Upon the Castros coming into the dealership ******* greeted them where he spoke to them about cars they had purchased from him in the past when he worked at a car lot. The Castros have been doing business with my family for over 20 years. Vern and Lori proceeded past ******* to my mother's office. They spoke and caught up with Kim. My mother then asked that I show them some pontoon boats that they might be interested in. I showed them a few and they decided on one. I then walked them into ********* office for him to take over on the finance side so he could at least make his finance income off of the deal. 

      ******* never gave us a notice of him leaving until the morning of him leaving. He had months of planning this move but yet didn't have enough of a backbone to give us a proper notice of him moving out of state. He even took the disrespect even further by requesting his last week of vacation time be paid to him as he was drive across the country. Giving us the proper and respectful notice would have allowed us to hire a replacement to work under him and to train for when he exited. 

      ******* has yet to reach out to myself as the owner of the company and previous boss about this matter. He's reached out to other employees which they have requested that he needs to take up this matter with myself. It is clear that ******* is in a financial hardship and could use the money. Did he sell this boat no.... but i will send him funds out of good faith.

      On Feb 22,2023 I purchased a boat from Bohner/Lacefield Marine out of ****** **********. It was a used boat and I am from out of state, so I requested full disclosure about any problems with the boat including scratches, dings, rips, or malfunctioning parts. I was told time and time again from their salesman ******* *** that the boat had “No blemishes whatsoever” and that their team always goes through the boats to make sure everything is working before they sell it. ******* gave these assurances multiple times and I still have all his emails to prove it. I believed his word and bought the he boat and had it shipped by a professional shipping company. The Bohner/Lacefield people traded the boat on the shippers trailer and I was present when the shipper unloaded it. I took the boat to a local boat shop who are the largest seller in the nation of my particular brand of boat. I asked them to get the boat ready for the summer and to check the boat over. They found cracks around the rudder box and was told by two of their technicians that the cracks had been there for “quite a while”. I asked if it could have happened somehow during the transport and they strongly assured me the cracks occurred months to years ago judging by the discoloration around and into the cracks. The quote to fix it came to over $3,500. The boat is still usable, so we took it out in a lake to check everything else and found the speed cruise paddles on the steering wheel were also not working and requires them to be fixed. I wrote and email to ******* explaining these issues and how I felt taken advantage of and asked for them to cover the costs of the repairs. I received an email back from the company owner who said they would not pay for the repairs and refused to accept responsibility. Money is only part of the issue. It’s the fact they gave me their word multiple times that the boat had zero problems when in fact there are two significant problems. They are misleading and straight up liars.

      This boat is a 2018 Centurion Ri237 and was sold as is no warranty. Also declined to purchase any extended warranties. This boat was in flawless shape while in our possession and we have no records of these damages which we inspect prior to even listing the boat for sale. The purchasing customer had planned a trip to come see the boat in person and test drive the boat but ended up canceling that trip. The boat was in our storage facility for several months while they lined up shipping. They declined the shipping that we offered which would of left of liable for the boat while in transport. When the transport company the customer contracted with showed up to load the boat on his flat bed trailer the driver began to use a winch to pull the boat and trailer onto his rig. We feared he was going to damage the boat so we offered to use our fork lifts to safely load the boat. Once the boat left our facility we are not responsible for anything that happens to the boat or trailer from there. The boat traveled over 800 miles in which we have no control over any road side items that could of kicked up hitting the rudder or if the driver ran a strap across the rudder which would put pressure on the rudder and could cause the cosmetic stress cracking. In our initial inpection we also do not show that the paddle controls for the speed system to have any issues. 

       

      We stand behind our response that we are not liable for the boat after it leaving our possession. The customer had all opportunities to come inspect and test drive the boat here as well as have us safely ship the boat and to purchase any extended warranties.

       I am rejecting this response because:

      Obviously the businesses system of inspection is wrong. I provided pictures of the cracks that show they have been there for a long time. The boat was hauled on a flat bed trailer, so there was no way something could have been kicked up that high anyway. I was NEVER offered ANY extended warranty. I have every email communication from the business and I was never offered an extended warranty. I canceled my trip, because after talking to ******* on the phone, I felt I could trust his word that everything was fine with the boat and a trip there wasn’t necessary. I just spoke with the repair people and the cruise handles required a major repair as well…the entire screen had to be replaced. I haven’t received the bill on that yet to send. But obviously, the handles were broken otherwise it wouldn’t have needed repairs…so their inspection completely missed that. The owner and salesman are completely trusting their inspection people and are ignoring the fact that they missed two major problems and lead me to believe I could trust their inspection and everything was flawless.
