    On March 13, 2023, BBB Serving Los Angeles and Silicon Valley requested that the business substantiate, modify, or discontinue claims advertised on http://getvivo.com. The company advertises: Ranked #1 – We take our reviews seriously.”


    The BBB Code of Advertising states, "1.1 The primary responsibility for truthful and non-deceptive advertising rests with the advertiser. Advertisers should be prepared to substantiate any objective claims or offers made before publication or broadcast. Upon request, they should present such substantiation promptly to the advertising medium or BBB.” 

     

    The BBB Code of Advertising also states, “28. Superlative statements in advertisements about the tangible qualities and performance values of a product or service are objective claims for which the advertiser must possess substantiation as they can be based upon accepted standards or tests.     Been calling this company to confirm cancellation of my expired contract since December of 2022, but the lady kept on asking if I can continue with the service at lower rate, I said NO, as I no longer use their device and monitoring service. I sent them a copy of the expired contract and a last payment of $34.99 last Jan 30, 2023 via registered mail and with a letter requesting for a confirmation of cancellation upon en-cashing of the check, check was en cashed Feb 13, 2023 and I never got any email or mail from them. The lady I spoke to last Feb 15, 2023 says that she notified the department that handled account cancellation and will return my call within 24 hours but I never got one.Just today, Feb 24, 2023, they sent me another invoice numbered 3012023-17 for $39.99, felt like receiving an EXTORTION bill and I believe they are intentionally not responding to any emails and making a ran around to cancel my account to continue collecting.

    Customer never sent in any written notice of cancelation which is company policy stated on his contract and verbally informed him when he called in. His account has been cancelled since and billing terminated despite not following contract terms of cancelation policy

    We acknowledged the email we received from the customer however we don't know exactly what he wants us to do as we already cancelled his billing and will never get another bill/charge after February 2023. The letter of termination he sent dated January 30, 2023 and that includes a check that says his last payment has been processed. On the contract he signed it is stated after initial term he'll be automatically on a month-to-month basis and may terminate the agreement at any time upon at least 30 days prior written notice and this agreement ends on the last day of the (30) day notice period which is the first of March 2023 (today) that is why he received an invoice for the month of March but we replied to the customer via email to disregard that invoice (March Invoice). We also tried calling ****************** multiple times to talk about his past due balance prior to his 30 day cancellation as we needed to bring the account on a current status and unfortunately went to voicemail. If he has time we can discuss the balance to him as he left $279.92 past due amount to completely closed the account.
