      My original bid given to me back in ******** was for $14,570. 4/25/22 is the date the company initiated work on my house. That same day at 8:57pm at night. The owner ****** texted me to inform me that his ******* had informed him that the gutters needed to be replaced and the cost would be $4,695. On 4/26/22 at 1:52pm after removing the second layer of roof ****** again texted me along with sending me 11 photos to inform me that the workers discovered dry rot and that repairs are needed. I asked ****** the cost of the dry rot repair and I did informed him that I've now went over my budget after finding out the cost of the gutter and downspouts. He texted me back just minutes later with the breakdown of cost letting me know that 6 sheets of plywood is needed at $65 a sheet + $95 hour and that it should take about 3-4 hours to complete which would have came out $770 in total. I specifically asked ****** via text "so is there anything else I needed to know?" he responded seconds later "not at this time". There was no further communications of anything after 4/26/22 then I received a final bill on 5/02/22demanding payment of $28,345.38 stating that the job was complete. I immediately texted *************** day inquiring about the bill and if the roof was really completed. After going back and forth via a texted I decided to just call him since nothing was really making sense to me and that is when he informed me that additional rotting were discovered and that he was not aware of this until completion of repairs were already done and confirmed with me that the roof was not yet done and that it should be completed and done by 5/94/22.The company has now billed me for unauthorized repairs and has threaten to put a lien on my home.

      Lovett and Lovett Roofing Co. Inc. provided roofing replacement services at **************************************** for customer **** ***.  During the roof tear off process, our ******* was just starting to tear off the roof and uncovered a section of dry rot.  The customer was notified that an area of the roof had some dry rot and that wood repairs were needed in order for us to fulfill our contract agreement.  Our contract agreement has a time and materials clause that she signed and agreed to before work commenced.  We also verbally disclosed our T&M rate at $95/HR + materials.  At the time, the small section that was uncovered was disclosed to her with an estimated time of 3-4 hours of work.  

      As the job went on, more wood damage was uncovered and additional repairs were needed.  During the roof tear off process, her father was our POC (point of contact) on site as the owner lived out of state.  **** told us he would be there in case we needed anything.  Our job ******* walked him through every detail of additional work that was uncovered as the job progressed.  At this point in time, the job ******* had been in communication with the ****  Her father acknowledged the work that was pointed out and agreed to proceed with what was needed in order for us to fulfill our contractual obligation.  When the invoice was provided to the customer, she claimed she did not know about the additional work that was done and that her father was not there to OK additional work at the time.  We believe this was an excuse into trying to get out of paying for the work that was provided.  she contracted us to replace the roof for her father who lived there.  What better person to talk to about wood repairs when the customer is out of state and we were told he would be there for us?  We do not believe she was unaware of the additional work that was done on site as her father should have been updating her about the job as ****

      Attached are invoices associated with the additional work.  A copy of the final invoice and contract notating signed acknowledgment of our T&M clause under specifications item #2.  **** specifically told us that her father was on site to be her ****  He acknowledged the additional work and wanted us to proceed with what was needed.  We have full documentation of all photos of the wood work that can be provided upon request as this response terminal does not allow everything we have to show.

      Bottom line here is that our contract states our time and materials rate because we work on old homes often and run into dry rot almost on every job we do.  **** signed and agreed to this rate as it is part of our work specifications.  **** knew the building was old as she mentioned that her home had many issues and had foundation repairs done prior to our roof work.  We provided **** with excellent roofing service.  Her home has been improved and we require compensation for the additional work that was needed to be done.  The roof work could not have been completed unless these repairs were done.  The plywood was not nailed to code and needed to be re-nailed, the roof decking had substantial dry rot around the perimeters and edges of the roof.  These were all improvements done outside of our contract specifications,but still within our scope of work under out T&M clause.

      I am rejecting this response because: What the business has stated is untrue and about me appointing my father as POC (point of contact). I never ever once told them that my father would be point of contact for this transaction or any other transaction pertaining to this home. I stated to them back in January that my father will allow them access to the property so that they can access the roof and provide me with a bid. My father is 72 years old, with multiple health issues and slow memory loss being one of his health issues. My father speaks no english, so how would that even be possible for the ******* to communicate something so detailed to him? I have had 4 different contractors in and out of this home working on various projects for me and they will tell you that i have never once appointed my father as POC. ****** was made aware that i lived out of state on April 25, 2022 and has been in communications with me and only me up until the recent discovery of additional damages he claims that his foremen has found that is now costing me in addition to what he's already quoted of $6,700 which i was never notified or informed about. I've attached images of our text conversation to this email for review. I stated to ****** that the gutter has put me well over my budget for the roof ... so i am beyond puzzled that he didn't at all feel the need to inform me of an additional $6,700 cost, nor gave me the option to seek for a quote elsewhere? This project went from being $14,570 to now $28,345 while i was only under the impression that the total cost would be at most $21,000. This to me is bait and trap tactic. They proceeded with unapproved work and is now demanding for payment to be made and just expect the homeowner to pay it with no questions asked? The accusation being made about me having knowledge of this is false. I did not have any knowledge of this up until 5/3/2022 when the final billed was emailed to me. 

      Yes, the home is a beautiful victorian home built in **** and very well maintained. I was informed by my handyman April of this year that the home may be sinking due to a small crack in the concrete on the side of the house and after having had 2 ************************ come out to access the home they both concluded that the fondation was still in great condition and that i had nothing to worry about. I informed ****** of exactly that via email. If i did have foundation issues what does that have anything to do with the roof? This roof was replaced just about 16 years ago with still 14 years of life left to it. Since i was going through a hefty amount of remodeling i thought to myself why not just replace the roof so that the house can be in tip top shape and appealing to buyers when i go to sell the house in the near future. So again i am not sure of the correlation with the foundation and the roof given that they are 2 separate things.
