    Government Action: BBB reports on known government actions involving business’ marketplace conduct:
    Department of Justice vs. Meta Platform Inc.
    On June 21, 2022, Meta Platforms Inc. (formerly Facebook), entered into a settlement (Case 1:22-cv-05187) brought against the company by the Department of Justice. The settlement stems from allegations that Meta Platform engaged in discriminatory advertising , which was in violation of the Fair Housing Act (FHA).

    According to the complaint, Meta Platform’s housing advertising system discriminated against Facebook users based on their race, color, religion, sex, familial status, national origin and disability by using algorithms to define an “Eligible Audience” that enabled advertisers to exclude protected groups from receiving certain housing ads.

    As part of the settlement Meta will stop using their “Special Ad Audience” tool, will develop a new system to address disparities in its ad delivery system for housing ads and will pay a civil penalty of $115,054.00.

    Calif. Attorney General case 4-23-cv-054448

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

     
    On October 24, 2023, the California Attorney General filed a lawsuit against Meta Platforms, Inc., Instagram LLC, Meta Payments, Inc. and Meta Platform Technologies LLC. (Case 4-23-cv-054448).


    The lawsuit is the result of an investigation opened in November 2021 and alleges that Meta violated the Children’s Online Privacy Protection Act (COPPA), California's False Advertising Law (FAL) and California’s Unfair Competition Law (UCL). According to the complaint, Meta's misconduct includes creating a business model focused on maximizing young users’ time on its platforms, employing harmful and psychologically manipulative platform features while misleading the public about the safety of those features, publishing reports that present misleadingly low rates of user harms, and refusing to address harms while continuing to conceal and downplay its platforms' adverse effects.
     
     
    Along with California the following states are included as plaintiffs in the lawsuit.Arizona, Colorado, Connecticut, Delaware, Georgia, Hawaii, Idaho, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Michigan, Minnesota, Missouri, Nebraska, New Jersey, New York, North Carolina, North Dakota, Ohio, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Virginia, Washington, West Virginia, and Wisconsin.

    State of New Mexico vs Meta Platforms.

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

     

    On December 6, 2023, the New Mexico Attorney General filed a lawsuit against Meta Platforms, Inc., Instagram LLC, and Facebook Holdings, LLC (Case D-101-CV-202302838).

    The lawsuit is concerning the safety and protection for minors from predators and child pornography and allegations that Meta fails to remove Child Sexual Abuse Material (CSAM) across its platforms. Furthermore, the New Mexico Attorney General alleges the office has evidence that the platforms have:

    Proactively served and directed the underage users to broadcast sexually explicit images.

    Enabled adults to find and contact minors into providing sexually explicit content.

    Invitations to join unmoderated Facebook groups for the intent of commercial sex.

    Allowed the distribution and sharing of child pornography on their platforms (Facebook and Instagram)

    Allowed a fictitious mother to offer her daughter who is a minor to solicit to sex traffickers and to create a professional page to share advertising revenue.  

    The case is currently pending.

    Texas AG/Meta Platform

    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government’s allegations, which have not yet been proven.

    On February 14, 2022, the Texas Attorney General filed suit (case #22-0121) against Meta Platform, Inc. (Facebook) for capturing and using the biometric data of millions of Texans without properly obtaining their informed consent to do so from 2004 to current, in violation of Texas Business and Commission Code 503.001.

    The suit alleges that the company repeatedly captured biometric identifiers without consent, along with disclosing the identifying information to other entities, and failing to destroy the captured identifiers within a reasonable time knowingly violating the Texas Capture or Use of Biometric Identifier Act and the Deceptive Trade Practices Act.

    The case is currently pending.


    Pattern of Complaint

    Meta Technology Company came to BBB’s attention in February 2012.  A review of complaints was done in February 2024.  Based on BBB files, the company has a pattern of complaints.  The patterns found are, account security and suspension of accounts with no explanation.

    BBB has reached out to Meta Technology Company to address BBB’s concerns. To date, the company has not responded to our request.
