      The business sent me used motorcycle parts, when i purchased brand new parts.the business representative tried to convince me via phone and text message that the parts come blemished from the factory, and that they would be still functional.the part is a clutch bell, part of the motorcycle transmission. the clutch bell has scratches on the surface deep enough for me to fit in my finger nail, there is grease and dust residue all over the bell, the bell also has warped edges, also there is broken teeth inside the clutch bell where it attaches to the drive rod.the parts package arrived with scotch tape all over one of the manufacturer box, all the parts were in one package, the parts come in individual packages from the manufacturer.the seller has already opened all the packages. and made changes to the parts.the clutch bell is damaged and the seller continues to insist on installing the parts even though there is an obvious hazard present that could result in serious injury.the seller does not wish to send a replacement part, or issue a full refund. there is no explanation on why all the parts were removed from there original packaging and stuffed into one box. they are obviously used parts, the packages have already been pre-opened by the seller

      Customers aware that the item will need to be modified with a couple washers to extend it the teeth area. Based on the picture he sent us they are normal manufactured blemishes and it will not interfere with the function as customer claim. If he has buyer's remorse still want to return will make exception but he'll have to cover his shipping costs in order to be issued a refund which the customer just wanted to refund or exchanged without return of item required for warehouse to inspect his claim.

       I am rejecting this response because:

      images clearly show the item is damaged and in used condition, business owner acknowledges the item is damaged "blemishes". i believe their actions of selling used damaged parts could be defined as criminal neglect. whether the item was damaged during the manufacturing process, or damaged during previous use, it was still sold as a "new" part.

      if the part were to fail during motorcycle riding, it has the potential to cause severe injury or death.

      images also show all the individual parts were removed from their individual packaging, and repackaged in one package.

      business owner continues to pressure the use of damaged items, and is most likely is selling damaged parts to others as well.

      it only seems appropriate that a refund is provided, or a new replacement part is sent out. damaged part should be discarded too prevent injury or re-sale.
