      Paid the company $250 as retainer fee on 12/22/22 followed by $1992 on 12/23/22 for an interviewee who never showed up for her interview! I was requested to keep this as a credit and multiple people were introduced but none hired till June 5 where I paid additional $962 for a candidate who came at a higher hiring rate which included another retainer fee of $250 a** this was for a different position in the office. Attaching my paid invoices and agreement hiring on June 5th that in the event this candidate did'nt work out within 90 days the entire amount due for refund to me will be $2704. The candidate lasted for less than a month hence the request for refund, I have attempted multiple text messages and assured of refund till recently I was told she cant afford to pay back the refund. Please help resolve as this is direct breach of contract agrrement.

      We hired A-Team Dental Staffing to help us with our staffing needs and signed a contract in August 2021. In January 2022 hired someone on our own. Because they did not fulfill our staffing needs I requested a refund via text 01/10/2022 and the owner ********** said she will send us a refund check of $500. I also sent a refund request 01/18/2022, 03/24/2022, 04/12/2022, 04/23/2022, 04/29/2022, 06/02/2022, and 07/08/2022. It has been over 6 months and with several requests she has still not sent us the request. She also changed her number and I was not aware of it until I found her new number on her website.

      I am responding to the customer *********************** request for a refund. As per our Recruitment Agreement and Direct Hire Agreement under the section Compensation:

      The $500 refundable request fee is due at time of signing and will be deducted from the final direct hire fee at time candidate is onboarded. If within 3 weeks the recruiter has not referred or submitted qualified candidates, client may request to terminate the Direct Hire Agreement and have the deposit refunded. All refunds will be refunded with 10 days of request from client. Please refer to Recruitment Agreement for further details pertaining to this retainer fee.

      A-Team Dental Staffing L.L.C does not owe customer a refund because we did refer and submit qualified candidate(s) and the customer give the candidate a Job  Offer Letter.  I am not able to disclose the name or any information as it will be in breech of confidentiality. The customer may be willing to attach the Offer Letter that was emailed to the referred candidate. Customer *********************** has already provided the Recruitment Agreement that has the above statement in that agreement.

      I am rejecting this response because:

      Although you did send us a candidate and we were interested, the candidate did not meet the needs for our office. The candidate could not work the hours we asked for and it is the staffing agencies responsibility to provide us a candidate that meets our needs in which the staffing agency has on file and she did not meet our needs. The position was only offered to her if she met all requirements.

      As a courtesy, the agency said they will send us a full refund months ago and nothing has been refunded.

      In addition, we are supposed to only be charged a percentage of the working interview so we should receive the remaining part of the deposit back.

      I would like to respond to the rejection of the complaint and request of refund. How do I do this when the time has passed? 

      My Response:
      My business does not owe a refund as we fulfilled the obligation of recruiting, there is nothing in our agreement that guarantees a Direct Hire only that we would do our due diligence and recruit candidates and review resumes. We did exactly this, we informed the client of the request of the candidate and the client authorized us to move forward in the interview process and placed an offer letter to the qualified candidate according to the client. NO business should be expected to work for free as we also submitted JobAds and posts on social media and spent a significant amount of time headhunting candidates for this Direct Hire request.
