      My wife and I entered into a construction contract with A+. The agreement was for the remodel of a kitchen and bathroom in a rental property we own. The agreement was entered into December 13, 2022, with a completion date of no later than February 2023. The work was not completed until late July 2023, causing a rental income loss to us of $12,388, and utility and city service fees of $982. WE withheld the final payment of the construction as a partial offset for the losses we sustained. A+ placed a lien on our property. We seek an acknowledgement of the financial losses we suffered due to A+ breach of contract and a removal of the lien.

      The customer who left this review did not make the final payment after we successfully completed a kitchen and bathroom remodel for them and passed all necessary inspections. According to ********** law, contractors are rightfully entitled to compensation for their work. Following substantial efforts to amicably settle the payment dispute, A+ Construction had no choice but to file a lien on this customer's property.  
       
      A+ Construction placed the lien on this customer's property on 8/31/2023, for the amount of $9,581.00, because this customer failed to settle the due payment for the completed work.  
       
      This customer's refusal to address their financial responsibility, despite our attempts at resolution, compels us to initiate legal proceedings to claim the compensation we are legally entitled to. While pursuing legal action is always our last resort, the customer's refusal to make the final payment leaves us with no other choice. A+ Construction remains hopeful for a fair settlement that would allow us to avoid court.

      We are rejecting this response because: A+ Construction ("A+") is not accurate. There were no inspections. A+ violated the terms of the contract by not completing the work within the time frame agreed to and has refused to acknowledge the loss of income resulting from the breach. We promptly paid all invoices presented until such time as we started to receive invoices for work that had not yet been done. On many occasions we advised A+ representatives that the work was not being done, that we were continuing to lose rent and had a person patiently waiting to rent the home. We were concerned that the amount of lost rent would exceed the amount owed to A+. As it turned out, that was exactly what happened. 

         A+ filed a lien on the property prior to any attempt to resolve the dispute. We sought resolution by mediation, as required under the contract.  While we were trying to find a mutually acceptable mediator A+ initiate a lawsuit, further violating the terms of the contract. A+ has never acknowledged the losses we suffered in lost rent due to its very late (5 months) conclusion of the work. It has also failed to honor its warranty obligation. We too would like to avoid going to court, but A+ has to be willing to take into account the losses it caused by failing to meet the terms of the contract.

      In response to the recent message from the client, A+ Construction wishes to clarify certain points to ensure a full understanding of the situation.
      It is crucial to address the assertion regarding inspections. A+ Construction affirms that all work completed on the project passed the required government building inspections.
      Regarding the client's claim of responsibility for lost rental income, our contract specifies the scope of our obligations and liabilities. The assertion that A+ Construction is accountable for the client's loss of rental income does not align with the contractual terms agreed upon. Our responsibilities are explicitly outlined within the contract, focusing on the provision of construction services and not the financial management or investment outcomes of the client's property.
      Our decision to file a lien on the property on 8/31/2023, for the amount of $9,581.00, was a necessary step taken in light of the client's refusal to make the final payment for the completed work. This action does not preclude our commitment to resolving the matter through mediation. Filing a lien is a legal right under ********** law, intended to ensure contractors are compensated for their work, especially when payment disputes arise.
      We want to emphasize that initiating a lien is not contradictory to our willingness to participate in mediation. A+ Construction remains open and eager to engage in the mediation process as stipulated in our contract. We have been awaiting the client's selection of a mutually acceptable mediator to move forward with this process, demonstrating our ongoing commitment to finding a fair resolution.

      I paid around $35k for a full kitchen remodel & discovered that they botched the dishwasher plumbing 5 months after the dishwasher was installed. They were contacted immediately, came out, said they would fix it & that they were so sorry, multiple folks reassuring me they would take care of all the damage property, as I extremely distressed & ill from the mold. My floors, subfloor, drywall, insulation, everything was completely saturated, molded and compromised; all damage emanating from the dishwasher. I discovered the leak after running the dishwasher twice in a row and cleaning the floor on my ************** After several visits from the construction company over a few weeks, that included ripping out my drywall, insulation & flooring, they told me to they are not responsible, it must have been a leaky window- though all windows were involved in the remodel, making them still culpable. All my windows are the same age without ANY leaking, this was just an excuse to not be responsible for a botched job and a ruined house. The company refused an invitation for meditation I had my lawyer send. I filed a complaint with the county, as these people should not have a ************** responded to the county with fabrications.For the past 10 months, I have had a damaged & partially ripped out kitchen, that was unusable after their vandalism and falsifications. I paid $35k for a kitchen that now has damages totaling over triple that. They breeched contract, removed purchased property, used illegal practices to get around inspections (that ruined an appliance), & after reassuring me that they would repair & replace all that was damaged from their botched plumbing job. A+ Construction's disreputable practices and disregard for their work and customers is astonishing. Their BBB rating should reflect their ghastly practices.

      This email acknowledges the receipt of the complaint regarding the installation of the dishwasher on ******************** property. Having conducted a thorough investigation into the matter, our company would like to provide you with the following response:
      We hereby certify that the installation of the dishwasher has been completed to the best of our ability and in accordance with the highest industry standards. Our team of qualified licensed plumbers at ********************** (License # ******* has tested the dishwasher during and after the installation process back on 8/10/21, and no leaks were detected at any point during the project's completion. Furthermore, we have successfully passed the final inspection conducted by the city's qualified inspector, the date of the inspection was 10/22/2021, it was conducted by ******************* with "The ****************************************************, ******************* **************.
      As part of our commitment to ensuring the utmost quality of our services, we have conducted a comprehensive investigation into the reported issue with the kitchen window on the dishwasher wall. Our team ran a rigorous test and has confirmed that the aforementioned window is indeed leaking from the exterior (please see the photo and video taken on 2/8/22). Nevertheless, we made every effort to help **************** and deliver on our promise to have her kitchen look its best, investing both our time and money.
      It is worth noting that this window and its frame were not part of our scope of work and were not handled by any of our workers during the installation process, especially from the outside. We confirmed that there was a crack at the bottom of the window which allowed water to enter the wall and cause damage to the cabinets, walls, and flooring we installed. The leak was not apparent at that time as it was summer and there was no rain, thus there was no way of knowing this issue was present at the time we were doing the remodeling. When the rainy season began, water started flowing through the gaps and caused damage to the property. We also need to mention that the wall was still wet on the outside at the time of the appointment, which could not have possibly been caused by a leaking dishwasher. Though not responsible for any of the problems, we never backed down and were always open and ready to help.
      After sharing all of that with the homeowner on 2/9/22 (please see the screenshots attached), we have provided a detailed explanation of the issue with her window that had occurred. She realized that this matter should be addressed by her insurance company, which is a fair conclusion. We even offered our help and meet with them to show what happened exactly as we understand how challenging it can be for a person outside the industry.
      In order to help the situation, 2/4/22 our qualified specialist came out and removed the kitchen cabinets and flooring as they were damaged by water and had mold growing underneath to have them reinstalled.
      All the appointments, replacements, and installations at no extra cost for the homeowner. We stand by our actions as we made every effort to save the situation that had nothing to do with us, paying out of pocket as a sign of goodwill.
      Let me assure you that we take this concern very seriously, and we remain committed to providing the highest level of customer satisfaction. We stand ready to address any further concerns or questions you may have regarding this matter.
