      Breach of Contract between AV Party Rentals and ***** *******, dated May 29, 2021. Partial refund $150 requested. I rented 1 canopy, 8 tables and 40 chairs, for $687.50, for my late husband's Memorial Service on June 12, 2021. I drove 45 miles to Newhall because of the excellent services and "Delivery & Pickup Available Around the Clock", promised on company website. Per contract, the equipment was to be delivered and set up on Friday June 11. On Tuesday, June 8, I was notified that equipment was to be delivered Wednesday, June 9. Early delivery left equipment dirty and dusty on my lawn. My lawn browned due to heat and no water. The canopy was set up; tables and chairs were left stacked. On June 12, I had to clean and set up all tables and chairs. A local company would have cost less. There was a breach of contract as the delivery date should have been June 11.

      Business Response /* (1000, 18, 2021/10/20) */ The event rental industry has gone from one extreme to the other over the past twenty months. When most of the restrictions in California were lifted, our entire industry was overwhelmed with requests for equipment for the events that have been put on hold, including celebrations of life. Many Rental companies, including ones that are located in her area, began the practice of cancelling confirmed reservations because were unable to service them. We do not, we do everything we can to accommodate our clients. ***. ******* was informed when she placed her reservation that the delivery schedule would be made that week, and that we would contact her the day before with an approximate time. Every reservation we write for an event that happens Friday through Sunday is written showing "Out" Friday at 8:30 AM, and "In" Monday at 8:30 AM, in order to avoid overbooking equipment for multiple events. She was informed that Friday may not be the day of delivery. It is also stated on the front page of her reservation - "Please Note: The Delivery Day & Time and the Pick Up Day & Time May Not Be the Actual Days and Times of Delivery and Pick Up. We Will Notify You One Day Prior to Your Delivery and On the Morning of Your Pick Up With the Target Schedule." A copy is attached. The only day we were able to deliver to ***. *******'s area was Wednesday before her event. The crew for both delivery and pick up was both courteous and professional. The equipment was left stacked neatly for her use. It is unfortunate that ***. ******* lives in an area that is both breezy/windy and dusty. In truth, our staff busted their butts to make sure that ***. *******'s event was completed, and we are very disappointed that she cannot appreciate that. Every other client, including the three other events we had deliver along with her that day, have understood the circumstances, and have been very appreciative of the effort of our staff. We will not be able to change her mind concerning our service, and we can live with that. As for breach of contract, she was fully aware of the delivery and pick up terms, but failed to remember them when the week of her event approached, and refuses to acknowledge them to this day. Consumer Response /* (3000, 20, 2021/10/26) */ (The consumer indicated he/she DID NOT accept the response from the business.) When I rented the equipment for my party, the contract # ********** indicated a delivery date of Friday Jun 11, 2021. (See attachment 1). When they delivered it on Wednesday 9, they just crossed out the agreed dates. (See attachment 2). If they had informed me of the date change when I made my payment on 5/29/21, I would not have contracted with them. I live almost an hour away from AV Party Rentals. I wanted to be sure I was going to have a professional service. It wasn't. Without a doubt this is a breach of contract.
