    Department of Financial Protection and Innovation Consent Order for Edu Doc Support and Hau H. Nguyen

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On February 16, 2023, Edu Doc Support LLC and Hau H Nguyen entered into a Consent Order with the Department of Financial Protection and Innovation. The Consent Order settles allegations that the business engaged in unlicensed student loan servicing activities, engaged in unlawful, unfair, deceptive, or abusive acts or practices with respect to consumer financial products or services, and charged advanced fees for debt relief services. Under terms of the Consent Order, the business was ordered to desist and refrain from engaging in servicing student loans without the proper licensing and to desist and refrain from engaging in unlawful and deceptive acts and practices, pertaining to consumer financial products or services. Under the terms of the Consent Order, Hua Nguyen is ordered to desist and refrain from servicing any student loan in the state without proper licencing, desist and refrain from engaging in unlawful or deceptive acts and practices with consumer financial products or services, and desist and refrain from owning, managing, operating, or controlling any entity that services student loans, or which offers or provides any consumer financial products or services until he or the entity has the applicable approvals from the Commissioner and is complaint with the law. The business is ordered to refund 35% of all fees and payments they collected from California consumers from 2018 to February 16, 2023.

    In October 2021, BBB investigated Edu Doc Support's business practices. This investigation was prompted by an influx of consumer inquiries alleging that the business had misled consumers regarding the services they are signing up for.

    On October 18, 2021 BBB reached out to Edu Doc Support to request information about the business' debt relief services and possible advanced fees.

    The business has not responded to BBB as of October 31, 2021.

      Edudocprep rep claimed to be with ********** of ********* and told me they would apply my $799 payment toward my student loan. I found out later they were not with DOE and filed a protest with my credit union. The credit union denied my request because I sent the payment to the fraudster. I only became aware today that class action suits can be filed against these types of scammers.

      I feel very foolish and am pretty upset with this company. They approached me about a year ago stating I was eligible for the revised pay as you earn student loan forgiveness plan. They then outlined that I would be paying $199 a month for about 8 months, and then $49 a month for 36 months after that, and after that point the remaining about $67K of my student loans would be forgiven. So they made it seem these payments Ive been making for over a year were going towards my student loans, when they were NOT at all! They were simply going to the company as my fees for them preparing and submitting paperwork to get me approved for the REPAYE plan, then then doing my yearly re-cert paperwork for me, all while I could have done and be doing this paperwork myself yearly for FREE! Plus, because of covid-19, all loans have been in forbearance for over a year now anyways, so regardless of if Id been approved for the REPAYE plan or not, Id have been paying $0 a month right now anyways, yet I have essentially not been since Ive been having to pay this company per month! I now feel annoyed and upset Ive basically been cheated out of around $2K in the last more than a year, for nothing!!

I am sorry to hear that your experience was less than desirable and that we were not able to meet your needs.The Client Agreement you signed on March 12, 2021 clearly states that we are a private third-party document preparation company assisting borrowers with their enrollment into the assistance programs offered by the U.S. ********** of ********** The payments that were outlined to you during your initial enrollment with our company can be found within your Client Agreement, which states that your payments go towards our services in preparing your student loan assistance application.We have fulfilled our end of the Client Agreement, as we were able to get you enrolled into a repayment plan with the lowest monthly payment possible as well as have you recertified for another year. While the ******19 forbearance was in effect and no payments were required, the work that we did on your behalf to get your loans into a repayment plan allowed you to receive credits towards your student loan forgiveness. This would not have been possible if your loans were not consolidated into this repayment plan.Please accept our sincerest apologies for any trouble or inconvenience we have caused you. At your earliest convenience, please reach out to us so that we may be able to come to a satisfactory resolution. We can be reached *************. Again, we highly appreciate your feedback as it will assist us in becoming better at what we do.Respectfully,EDU Doc Support
