On March 21, 2024 I, entered in an agreement with Clear Air Lending. I borrowed $300 with terms of repayment of 42 weekly payments of $40.55 and a final payment of $39.12 for a total of $1742.22. I have since made 25 payments for a total of $1013.75 and the balance is still $296.06 as of 10/02/2024. I am struggling to pay my mortgage and utilities. I called and talked to an agent, they said I needed to email ****************************************** to see if I can get a hardship. I sent the email and it came back as blocked, saying I did not have access. I would like to have the remainder of this debt forgiven, with no negative impact to my credit report, as I have paid more than three times the amount of the loan.Business response

All rates and loan fees are prominently displayed within the loan agreement and disclosures and were acknowledged by Ms. *********** at each point by electronic signature.
Ms. *********** took out a $300 loan on 03/22/2024 and during the course of the loan term Ms. *********** contacted representatives to defer payment twice (which was granted) and revoke her ACH which was also honored as required. Ms. *********** also states she was unable to email ****************************************** we understand how that could be frustrating. We have checked to make sure that the email address is working properly.
Clear Air Lending would like to re-emphasize that the loan agreement is legally binding and based upon the review of the account and associated communications and documents electronically signed by Ms. ************ we have every right to expect payment as scheduled in the agreement.
Irrespective of these facts, as a gesture of goodwill Clear Air Lending will settle Ms. ************ loan for what has been paid. *** will waive any remaining balance including outstanding, late and returned items fees. We will also block Ms. ************ identifying information so no future applications will be processed.

I am writing to file a formal complaint against Clear Lending Air regarding a predatory loan I obtained in April 2024. Due to a desperate financial situation, I secured a loan of $500 from this lender. The loan agreement stipulated that I would repay the loan every other week for $145. To date, I have made these payments as agreed. I have paid the principle plus over $800 in interest. Despite this, the principal amount of the loan, the loan has not significantly reduced, and the overall cost of the loan seems to be disproportionately high compared to the original amount borrowed. Although my loan amount was $500 and I have paid over $1,300, my principle loan pay off is still $531. I did call to ask for them to waive my balance but I was offered a payment deferment, which I accepted or a settlement agreement. I called back again as they suggested to ask for a settlement. The settlement amount is $54 of 9 payments. That would be $1,786 on a $500 loan. Predatory loans are designed to exploit individuals in vulnerable or desperate situations, often through deceptive practices and unfavorable terms. I am asking for the business to waive my entire balance effective immediately, and I agree to never take a loan with them again. Again, I have already paid the principle that I borrowed plus an additional $800 in interest. I kindly request the BBB's assistance in addressing these issue since I was not successful.Business response

Hello, I'm filing a complaint I regard to a issue with this company who I owe money to that I have been paying back over the last month or so, the problem is I set up arrangements(15th and the 31st) to pay them back and because the amount isn't what they want, I'm getting emails, text and calls on a daily basis, their response is their are no arrangements set up, I have maid several payments which I have proof of, I sent text and called them stating as long as I'm paying them I shouldn't be getting any phone calls at all from them, they won't accept the fact that I'm paying them what I can afford every two weeks. I just want them to accept the arrngements and to stop texting, calling and emails daily.Business response

Clear Air Lending would like to re-emphasize that the loan agreement is legally binding and based upon the review of the account and associated communications and documents electronically signed by ******************, we have every right to expect payment as scheduled in the agreement.
Irrespective of these facts, as a gesture of goodwill Clear Air Lending will settle Ms. ******** loan for the principal amount borrowed. We will apply what has already been paid to the repayment of the principal. We will have a customer service representative reach out to ****************** to set up a payment arrangement for the remaining balance of principal owed. Provided ****************** sets up and makes the arrangement as scheduled we will consider the matter closed when the amount borrowed of $950 is repaid. If arrangements cannot be agreed to, or payments are not made as scheduled, we will continue with collection efforts as afforded to Clear Air Lending. We will also block Ms. ******** identifying information so no future applications will be processed.

I am rejecting this response because: I sent emails to the business because my bank account was compromised and I immediately reached out to clear air lending through emails which I have every last one of them, each email had an apology for this happening to my account with ********************** air, I had all intentions of paying them back and I still will pay but I had no choice to revoke payments through this bank because money was taken from my account and it would have affected my achs that were due, so ***************** reached out when this happened, my only once I started paying it back the company was still calling me stating arrangements need to be made (which they have) but I will not be harassed when I'm making a effort to clear this up, furthermore I don't care if you block me from future loans I have paid with no problem so whatever to this letter you wrote on behalf of this complaint, Hacking is happening all over the world I'm not happy about what happened to my account I lost money so I will call and pay and then you block whatever I don't care I see how ya really are.

Clear Air Lending is a predatory scam company that has gained unauthorized access to my banking information. Clear Air Lending created fraudulent documents by inserting my name and an unauthorized electronic signature. Approximately one month ago I applied for a personal loan from Clean Air Lending,**************, was notified I was approved, and then I tried to cancel the loan. I called the above referenced number, and was directed to an automated service. I am unable to contact a live person, and have been charged approximately 133 percent interest. This is a predatory lending company that is charging outrageous fees. You must submit in writing to ****************************************** of(i) your decision to cancel this Agreement and (ii) your authorization for us to debit your bank account for full principal amount of your loan. If you do not return your loan proceeds by the Rescission Deadline then your attempted rescission will not be valid and you must abide by all repayment obligations in this Agreement. The loan agreement signed by ******************** is legally binding, we have every right to expect payment as scheduled in the agreement.The customer can pay off the loan in full at any time with no prepayment penalty.
Irrespective of these facts, as a gesture of goodwill Clear Air Lending will settle Ms. ********* loan for the principal amount borrowed. Also I ask that Clear Air includes a live billing contact person to accept and process my payment for the principal amount of one-thousand dollars minus any previous payments I made to Clear Air. I asked to make a payment on July 25th 2024 to them. If they accept these conditions, and I receive their agreement via email, then I will be satisfied with this resolution.

Through an enterprise of the tribal trust of the dba Clear Air Lending. Your loan is offered by ******** ******** Services DBA Clear Air Lending. ******** ******** Services DBA Clear Air Lending is a corporate subdivision of the ******** ******** Development Corporation, a wholly owned federally chartered corporation and an economic development arm of the ******** Rancheria of Pomo Indians of ********** (the "Tribe"), a federally recognized and sovereign Native American Indian tribe. This service is offered to you via the internet from the Tribe's trust land. I submitted an application for a $900 loan. It was approved on 4/15/2024. The $900 for an emergency loan was never received into my bank account. I received an email from Clear Air Lending about my repayment starting on 4/24/2024. This business has an automated phone system that allows no contact with an actual customer service representative at **************. This number gives an after hours message at 10 am in the morning. I have the email from them with the loan number. This business is charging me for services that I never received and I have no way of contacting them. The loan was funded to the bank account number provided by ****************; however, the funds were returned from the bank as a closed account. **************** attempted to reach a customer service representative at a time representatives we unavailable. Clear Air Lending makes every effort to treat our customers as we would want to be treated, and certainly understand ****************** frustration. We sincerely apologize, and a representative will be reaching out to **************** to see how we can facilitate a satisfactory resolution.

************************ contacted representative's multiple times via chat to pay off her remaining balance in full. Representatives advised her she would need to wait until her upcoming payment had been posted in order to pay off the remaining balance, as her upcoming payment had already been sent for processing and it was unable to be cancelled.
Given the fact that ************************ has submitted payment for the total balance of the loan, and assuming this payment clears, Clear Air Lending will consider this loan closed. Furthermore, CAL will block Ms. *********** information to ensure no future applications are accepted, or processed, unless communicated to CAL in writing by ************************.

I thought I was getting a normal loan. They said I was approved for ******************************************************************************************************************* close to 3000 dollars to pay it back with a 667 interest rate. They did not disclose that information until after. I can not afford to pay almost 3000 dollars for a 550 dollar loan nor should I have to and when I tried to cancel it the website would not let me do so. I am very angry that they are trying to take advantage of me and who knows how many other people!Business response

Clear Air Lending is in receipt of the complaint filed by *************************** with the BBB. We take all comments good and bad very seriously, and the response below is a summary of our findings:
First, we would like to take this opportunity to provide you with some background information on our company, its business practices, and our actions in response to our customer ***************************. ********************** is committed to complying with the spirit of all applicable ***************** Consumer laws and the ******** Rancheria of Pomo Indians of ********** Tribal Lending Ordinance. During the application process, **************** was provided with documents detailing the loan terms and conditions, as well as repayment options. During the application process, **************** also signed all disclosures and the loan agreement electronically. As part of the loan agreement and required by the principals of ***************** consumer law Clear Air Lending disclosed the total cost to the borrower if only the minimum payment schedule is followed, and we inform our customers that this is an expensive form of borrowing. Specifically, the APR is disclosed in the loan documents that were reviewed, made available, and signed by the customer. All rates and loan fees are prominently displayed within the loan agreement and disclosures, and were acknowledged by **************** at each point by electronic signature.**************** took out a loan on Friday 3/15/24 and emailed to cancel the loan after business hours on the same day. Per Ms. ******* request, an agent has set up a calendar event to debit the principal only draft on Wednesday 3/20/24 since the loan is scheduled to credit Ms. ******* **** account on Monday 3/18/24.
Based upon the review of the account and associated communications and documents electronically signed by **************** we have every right to expect repayment of the loan based upon the disclosed and agreed upon terms.
Assuming this payment clears, as a gesture of goodwill Clear Air Lending will consider the loan cancelled. We will also block her identifying information so no future applications will be processed. If the payment is returned we will contact **************** to manage the return of the funds borrowed, and we will continue efforts to collect the unpaid principal balance.
