Pattern of Complaint

BBB files indicate that this business has a pattern of complaints concerning consumers alleging the business is not fulfilling purchase orders, not sending confirmation emails or order updates. Also, consumers advise updates are only received when they reach out directly to the business. Lastly, consumers advise that the business is not addressing their requests for refunds. On March 16, 2023, BBB submitted a written request to the company encouraging them to address the pattern of complaints. As of April 03, 2023, BBB has had no response.

Alert

On October 21, 2020, BBB investigated Soft Serve Clothing's business practices. This investigation was prompted by consumer complaints. These complaints shared concerns regarding the business failing to fulfill orders, respond to consumers, and honor their return and exchange policy.

BBB sent an email to Soft Serve Clothing asking the business to address and provide BBB with the following: 

- how the business fulfills orders, 
- how consumers can return or exchange purchases, and 
- how consumers can contact the business.  

BBB also sent the company an SBQ (Standard Business Questionnaire) form to obtain more information on the business, its structure, management, etc., however the business failed to return the form.

 

Additionally, BBB requested Soft Serve Clothing to modify, substantiate, or discontinue claims on their website that read, "Amazement Guarantee"; "Lifetime Warranty"; "Eco-Friendly"; "Made in the USA"; "24-48 Hour Shipping". The website also does not feature a privacy policy.

BBB's Code of Advertising Section 1 states, advertisements should be truthful, sincere offers to sell. Advertisers have a responsibility to have substantiation for all claims made and should be able to provide that substantiation upon request. Code of Advertising Section 20 states, when using the term “warranty” or “guarantee” the advertiser should clearly and conspicuously include a statement that the complete details of the warranty can be seen prior to the sale which could include putting it on the seller’s website. Code of Advertising Section 36, states advertisers should avoid broad, unqualified environmental claims. Code of Advertising Section 37 states, "Made in USA," and similar terms used to describe the origin of a product must be truthful and substantiated. In general, all or virtually all of the product must be made in the USA. 

As of December 1, 2020, the business has not responded to BBB's request.
