      On April 25th I purchased a vehicle from this establishment. When my Dad was taking a look he asked the gentleman showing us the truck about SMOG, he stated it had passed smog and I responded that they had to provide a 90 Smog Certificate anyway by law and the gentleman nodded yes. We checked on a few other things then offered made an offer which they accepted. The office manager gave me all the paperwork to take to the **** It was almost 5 so I went the next morning, paid all the fees and the clerk told me the smog certificate was missing and only gave me a temp permit so I could go get the 90 day Smog Certificate from the seller. I called Kings Towing and they said they would.not provide the certificate and everyone knows when you purchase a vehicle from a towing company your not going to get a smog certificate. I started that we had had a conversation with the gentleman who showed us the truck and even spoke about the smog and at no time was I told that they would not be violating the vehicle code **** B2 by not providing the smog certificate. She then said give me your number and let me check into it and she would call me back. They never called back and no longer answer when I call. I am sure it will be no surprise to you when I share that the vehicle does not pass smog and needs multiple issue resolved before it can approximately $5000 worth of repairs in order to get it smogged. I went to the *** and reconfirmed that they where responsible.to provide a 90 Smog they said yes and to file a small claims against them. I sent a demand letter no response. Also in the interim I discovered they disengaged the odometer so the mileage told.to me was false and I also discovered the cleared the engine fault codes which cleared the engine light from being on two days prior toe.purchasing the vehicle. I either would like for them to get it smogged or my money and *** fees returned and I will give them their truck back.

      I am rejecting this response because:  it clearly states in ********** vehicle code 24007b2 that the seller must provide a valid smog certificate before or during the sale of a vehicle the only other option is to create an agreement between the seller and the buyer stating their claim of a sign on the wall stating no smog provided I never saw a sign like that however I didn't look at every single picture I have sayings on my walls it does not make them factual it must be an agreement signed off by both they can distort the truth and claim false things the vehicle code is there for a reason for people just like this.  It was a clear conversation with the gentleman that showed ** the truck the ramble on about irrelevant things like the registration freezing how I went there yes I crossed my teasing out of my eyes yes the person who served the papers was in the vehicle which you will see has no license plates because it can't pass smog why would anyone buy a vehicle they could not pass smog and their claim of everyone knows it's salvage no I did not get a salvage they have a huge sign says clearance used cars doesn't stick one other thing that they put in their response they're just trying to bury the facts with ramblings bottom line it's the law you never had an agreement to any such thing otherwise and it is not in the contract and I said they said it was on the wall why wouldn't you have it in the contract what you put it in a small prints of the person buying the vehicle wouldn't know that you put it on the wall so the person behind the vehicle wouldn't know very unprofessional and very untrue.  We will continue this conversation between better Business bureau and the court I will also copy the court on their response that it's no employed because they have a sign on the wall and I'm sure the judge will correct them that that does not constitute an agreement craziness.  Please excuse any typos or grammars I did not know there was a 30-minute limit and then you couldn't respond and I had clicked respond and was discussing with my dad how they were claiming that we were lying about the kid and the conversation about small so forgive how this is probably not the most professional response

      Ive attached the requirements for selling a lien vehicle, and the documents that are included in the lien sale with Wreath Opps signature at the bottom of the form. Non of those documents listed are in "fine print"or hidden on the form. It is clearly labled and located at the center of the form as well as sellers warranty and buyers responsibility of registration compliance. We have been selling lien vehicles for several years. We have never had a complaint regarding smog or a assumption that smog is required by the towing company. We sell cars AS-IS which means if the check engine light is on it is sold with the check engine light. If the battery becomes disconnected due to faulty wiring or back battery connectors, that is solely how the vehicle came into our possession. We do not "rig" the odometer or alter the vehicle codes in anyway, and we also allow. customer to bring their own code readers and read the codes as part of THEIR INSPECTION of the vehicles condition. All buyers are made aware these are impounded vehicles and King ********************** and all of its employees have little to no information on the mechanical condition of the vehicles. Wreath Opp was made aware of this the first time she came into the office before the purchase of the vehicle. ********** Veh. Code ******* (E) (2) clearly states the subdivision does not apply to any lien sale, those documents and. supporting documents have been uploaded as well. The California DMV ****************** can also be reached at ************* to verify any questions regarding Lien Sale Vehicles, as Wreath Opp is treating this as if she bought a vehicle from a private party or a car dealership, which we are neither.
