This company took over for landlords and after waiting on huge water leak (5 years)took their time repairing leak. Mold had accumulated which contributed to my becoming ill and being diagnosed with an autoimmune disorder.Business response

Dear BBB: We took over the management of this property on 12/28/2020. We can not answer to issues that occurred prior to our management of the property. We have no knowledge of any mold in the property however we have addressed all repair issues submitted by the tenant since we began managing the property. It should be noted that this tenant is a chronic non-payer of rent and they are currently very far behind on rent despite receiving large amounts of rent assistance. This has resulted in this tenant receiving a 60 days notice to vacate which expired on 1/17/2022. Although we had the right to start eviction on that date, we have allowed the tenant an extension to vacate despite the fact that she is extremely behind in rent and the owner may never recover these funds. We believe that this complaint is in retaliation of the 60 day notice to vacate that the tenant received and she is making efforts to stall her exit even further.

I am rejecting this response because:
It is all untruthful but it’s expected from them. Their reviews are horrible.Repairs were not done until April, 2021. They first went through a walk through than made me wait 4 months to initiate repairs. This included garage door which had been broken almost a year before it was repaired. Regarding labeled a habitual late rent paying tenant the 60 day notice was never sent they have a 3 day notice to pay or quit. Rent was paid 2 weeks late but they said the notice to move stood. As to comment owners will not be paid for the 2 week extension they shouldn’t be allowed to project comment as they don’t know the status. Payment has been drawn by cashiers check going directly to owners instead of management so they can’t attach all fees and owners not receiving entire payment.Thank youBusiness response

Dear BBB,
The tenant is currently $3,563 behind in rent in spite of receiving $23,615 in rental assistance during the past 2 years.
The tenant was given 60 day notice to vacate which expired on 1/17/22. We already granted a one month extension with no payment in an effort to allow the tenant move out on her own and help the tenant to avoid having an eviction on her record. Please see attachments.
The tenant is making every effort to avoid leaving the property at the end of the extension period which is 2/17 (this week Thursday).
If the tenant is not out of the property by 2/17/22 we will have no choice but to start the eviction process. The tenant will then have the opportunity to defend her case in front of a judge who will make justice in this matter.

The management company and/or owner are withholding 2,842.50 of our security deposit and have not provided any invoices or receipts of the "repairs" or cleaning. I tired to contact the owner DJL of the Desert on October 23rd and was sent to voicemail. I have only been in contact with the management company via email, the owner has been included on every email but has not responded. The management company is stating we are being charged because we did not have unit professionally cleaned, we did not receive the unit professionally cleaned. per CA Civil Code: CIV S 1950.5 (3) - The cleaning of the premises upon termination of the tenancy necessary to return the unit to the same level of cleanliness it was in at the inception of the tenancy. We were also advised if we did hire a cleaning service and it was not to the owners liking; we would be charged regardless. We are also being charged for wall repairs when we did not leave any excessive damages and no major damages were noted during our pre-move out inspection. We even obtain the correct paint color from Owner to avoid these fees and we haven't received a copy of the pre-move out inspection. We have read numerous reviews and All County has a reputation of holding security deposits without receipts and invoices from other patrons. We believe our security deposit is being held in bad faith and would like the management company held to the extent of the law per CA Civil Code: CIV S 1950.5 (l) The bad faith claim or retention by a landlord or the landlord’s successors in interest of the security or any portion thereof in violation of this section, or the bad faith demand of replacement security in violation of subdivision (j), may subject the landlord or the landlord’s successors in interest to statutory damages of up to twice the amount of the security[...]. we would like to request twice the amount of our deposit returned because we have not received any receipts or invoices when we requested them nearly a month agoBusiness response

The tenant vacated the property on 10-1-2021. We conducted a pre-move out inspection with the tenant prior to move out and advised the tenant at that time of several issues that needed to be addressed prior to move out. The tenant vacated without cleaning the property or handling handyman items although they were advised to do so. There was dog poop left behind in the yard that had not been picked up. The property is newer construction and had been cleaned and freshly painted prior to move in. After only one year of tenancy, all of the walls had damage that necessitated repainting before it could be re-rented. Although the owner could have charged the tenant more money, he charged the former tenant only half the cost of repainting the unit. Although we have photographic documentation of the damage to the unit and we support the owner's decision to withhold money from the tenant's security deposit for repairs, the reality is that were were not responsible for security disposition. The owner was holding the security deposit, and handled all of the repairs independent of us. The owner also mailed a refund check directly to the tenant as was his legal right. From our perspective, we feel that if the tenant had turned over possession of the property in the condition that they received it, they would have received their full security deposit back, however this did not occur. The owner therefore exercised his legal right to recoup a portion of his costs from the deposit. Thank you.Customer response

I am rejecting this response because: We still have not been provided any itemized invoices or receipts for any materials or labor for the work that was completed. The management company reached out prior to their response through the BBB to try and come to an agreement. I did not respond to their message and prefer to have our contact be through the BBB. We are not going to accept anything less than our deposit returned in full because we are certain our deposit is being kept in Bad Faith. We do not agree to the unreasonable charges for the repainting of the unit or other charges. There are several reports from other people online who have had their deposits kept for invalid claims. We also have photos showing the apartment was not handed over professionally cleaned and photos showing the unit was not left dirty.
