A Contract was signed and dated on 7-15-2021. I was told by the Senior project design specialist (*************************) that a construction project manager(*******) would be at our job site everyday to supervise the job. He in fact didn't tell the crew that bull-nose pavers were to be used. So the crew continued with the job. They had to rip out the present work done to correct the problem. ******* abandoned our job to go to another site to leave the crew to finish the job. The job was don't done according to measurements nor were the paver placed professionally. They had a continuation of the original contract to do our backyard with pavers. The company president ***** called us to inform us that the crew will not be doing the job and gave many excuses as to why. The fact of the matter is Viking Pavers Construction is in breach of contract.

      Business response

      09/14/2021

On 7/15/2021 Viking entered into a contract with ************************* for $10,338 to install pavers and steps in front of her home after a dispute with another contractor where the work was started but not completed.

We started this job on 7/27/21 and during install there were some disagreements regarding the amount of bullnose that ****** thought should be installed, vs the drawing and contract she signed, however as a matter of customer service we did install ~30 linear feet of extra bullnose step for her (normally this would be a  $2300 charge). Viking completed the work on 8/2/21 and ****** said she was happy and paid us in full on 8/2.

A larger misunderstanding came up during the install regarding a possible change order. ****** asked if we could do an install in her back yard with some material left over from a previous contractor that she had a dispute with. Viking typically does not install material we donr source ourselves, but we wanted to help her out because she told us the previous contractor took her money and left. Viking gave here a change order price that we would execute while the crew was still there and told her we could do this as a change order while the crew was still on the job. However she never moved forward or gave us any payment for this change order while the crew was still on the job.

****** ultimately decided that she wanted the extra work done after the crew was gone and working a new job, she insisted that the crew start on 8/9 or she would charge Viking $250 a day. Since we are in a severe labor shortage there was no way we could get this done with the crew already working elsewhere, and the change order was meant to be done while the crew was still there. When I tried to explain this to ****** she stated that she was going to file a complaint and hire another company. The extra work in question was completed recently by another contractor.

Viking ultimately did everything and more than the original agreed contract scope of work, and we stand behind this work. We are more than willing to remedy any minor issues that *** arise as part of our warranty.
